On 8 June 1993 the Council passed a resolution on the quality of drafting of Community legislation.
The Commission is committed to improving the quality of drafting of legislative texts and with this in mind is cooperating with the Council and Parliament to produce common guidelines.
The Council adopted, for its part,the interinstitutional agreement on common guidelines for the quality of drafting of Community legislation.
On 8 June 1993 the Council passed a resolution on the quality of drafting of Community legislation, with"the general objective of making Community legislation more accessible.
This would go against the Interinstitutional Agreement of 22 December 1998 on common guidelines for the quality of drafting of Community legislation.
The efforts concerning the quality of drafting, the delivery of texts, monitoring of the implementation of the rules and simplification of the acquis also contribute to this end.
We place great emphasis not only upon the improvement of the quality of drafting, but also upon reducing somewhat the quantity.
The Conference considers that the three institutions involved in the procedure for adopting Community legislation, the European Parliament, the Council and the Commission,should lay down guidelines on the quality of drafting of the said legislation.
By way of general conclusion, we in the Legal Affairs Committee regard the quality of drafting and simplification of legislation as an important remit.
Concerning amendment 24, the proposed change should be introduced in the body of the text rather than ina recital, in accordance with point number 10 of the Interinstitutional Agreement of 22 December 1998 on common guidelines for the quality of drafting of Community legislation.
Further to the conclusions of the latter,the Council adopted on 8 June 1993 a resolution on the quality of drafting Community legislation. This laid down guidelines for drafting Council acts.
It should also be recalled that on-going effort is being made to ensure improved drafting quality and clarity of EU legislation andthat detailed guidelines for this were set out under the 1998 Inter-institutional Agreement on quality of drafting of Community legislation.
A review of thecurrent European contract law acquis could remedy identified inconsistencies, increase the quality of drafting, simplify and clarify existing provisions, adapt existing legislation to economic and commercial developments which were not foreseen at the time of adoption and fill gaps in EC legislation which have led to problems in its application.
The role played by the institutions'legal services, includingtheir legal/linguistic experts,in improving the quality of drafting of Community legislative acts should be strengthened;
They adopted drafting guidance inthe Inter-institutional Agreement of 22 December 1998 on common guidelines for the quality of drafting of Community legislation.
Certain technical changes have been made to the text to improve its conformity with the InterinstitutionalAgreement of 22 December 1998 on common guidelines for the quality of drafting of Community legislation(OJ C 73, 17.3.1999, p. 1), drawn up pursuant to Declaration No 39 annexed to the Final Act of Amsterdam on the quality of the drafting of Community legislation.
The applicants refer in that regard to theCouncil Resolution of 8 June 1993 on the quality of drafting of Community legislation OJ 1993 C 166, p. 1.
The first is the Inter-institutional Agreement of 22 December 1998 on common guidelines for the quality of drafting of Community legislation see above Section 2.2.g.
However, a political binding commitment as it is contained in the proposed 2nd paragraph of the 3rd recital should not take the form of a recital as itcontravenes the"Inter-institutional Agreement on Commission Guidelines for Quality of Drafting of Community Legislation" which foresees that recitals"shall not contain normative provisions on political exhortations.
