(46) The Commission should be able to lay down detailed rules concerning the implementation of this Regulation in accordance with the procedures for the exercise of implementing powers conferred on the Commission.
On 17 July the Council amended(1) the decision laying down the procedures for the exercise of implementing powers conferred on the Commission(2) to add a new procedure: regulatory procedure with scrutiny.
That is why I voted in favour of this proposal for a regulation laying down the general principles for control by Member States of the Commission's exercise of implementing powers.
(2) the Council adopted Decision 87/373/EEC of 13 July 1987 laying down the procedures for the exercise of implementing powers conferred on the Commission(4); that Decision has provided for a limited number of procedures for the exercise of such powers; .
These committees were governed by the rules set out in Council Decision 87/373/EEC of 13 July 1987 laying down the procedures for the exercise of implementing powers conferred on the Commission(6).
Council Decision 1999/468/EC of 28 June 1999, laying down the procedures for the exercise of implementing powers conferred on the Commission, as modified by Council Decision 2006/512/EC, repealed by Regulation(EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011,laying down the general principle concerning mechanisms for control by Member States of the Commission's exercise of implementing powers.
Having regard to its resolution of 25 February 2014 on follow-up on the delegation of legislative powers andcontrol by Member States of the Commission's exercise of implementing powers(17).
In accordance with Article 291 TFEU, rules andgeneral principles concerning mechanisms for the control by Member States of the Commission's exercise of implementing powers are to be laid down in advance by a regulation adopted in accordance with the ordinary legislative procedure.
The Commission shall, within six months of the date on whichthis Decision takes effect, publish in the Official Journal of the European Communities, a list of all committees which assist the Commission in the exercise of implementing powers.
Where reference is made to this paragraph, Articles 5 and7 of Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(24) shall apply, having regard to the provisions of Article 8 thereof.
Those powers should be exercised in accordance with Regulation(EU) No 182/2011 of the European Parliament and of the Council on laying down the rules andgeneral principles concerning mechanisms for control by the Member States of the Commission's exercise of implementing powers.
(10) The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(7), and it is appropriate therefore that those measures be adopted under the management procedure laid down in Article 4 of the said Decision.
Those powers should be exercised in accordance with Regulation(EU) No 182/2011 of the European Parliament and of the Council22 laying down the rules andgeneral principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers.
Whereas the Commission, assisted by a committee of representatives of the Member States, should be authorized,in accordance with the procedure laid down in Council Decision 87/373/EEC of 13 July 1987 laying down the procedures for the exercise of implementing powers conferred on the Commission(5), to make certain Eurocontrol standards mandatory at Community level;
Those powers should be exercised in accordance with Regulation(EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules andgeneral principles concerning mechanisms for control of by Member States of the Commission's exercise of implementing powers.
(63) The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(18).
Those implementing acts will be adopted in accordance with the provisions on implementing acts laid down in Regulation(EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules andgeneral principles concerning mechanisms for control by the Member States of the Commission's exercise of implementing powers.
(5) The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission9.
Where the control of Member States is required those powers should be exercised in accordance with Regulation(EU) No 182/20112 of the European Parliament and of the Council of 16 February 2011 laying down the rules andgeneral principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers.
(7) The measures necessary for the implementation of Directive 93/53/EEC are to be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(5).
The next item is the report by Mr Százjer, on behalf of the Committee on Legal Affairs, on the proposal for a regulation of the European Parliament and of the Council laying down the rules andgeneral principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers- C7-0073/2010-.
(12) The measures necessary for the implementation of this Decision should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(6).
In the course of the legislative procedure relating to that recast proposal, it became apparent that certain existing provisions contained in Regulation(Euratom) No 3954/87 have now become incompatible with the new"Comitology" system laid down in Regulation(EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules andgeneral principles concerning mechanisms for control by Member States of the Commission's exercise of implementing powers.
(20) The measures necessary for the implementation of this Regulation should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(8).
(16) The measures necessary for the implementation of this Regulation should be adopted in accordance with Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission(4);
Whereas the procedure by which the committee will decide should be Procedure III A of Article 2 of Council Decision 87/373/EEC of 13 July 1987 laying down the procedures for the exercise of implementing powers conferred on the Commission(5);
