The duly authorized inspectors of an inspecting State shall have the authority to inspect the vessel, its licence, gear, equipment, records, facilities, fish and fish products and any relevant documents necessary to verify compliance with the relevant conservation and management measures.
As a safeguard, article 21(12) and(18)provides that the decision of the flag State to fulfil its responsibilities under the Agreement supersedes any action taken by an inspecting State with respect to a vessel suspected of having committed a violation and that all States are liable for damage or loss caused to fishing vessels due to unlawful or excessive enforcement actions taken by them.
In the latter case, the inspecting State is required to communicate the results of the investigation to the flag State, which must, if evidence so warrants, take enforcement action or authorize the inspecting State to take such enforcement action as the flag State may specify.
The inspecting State shall require its inspectors to observe generally accepted international regulations, procedures and practices relating to the safety of the vessel and the crew, minimize interference with fishing operations and, to the extent practicable, avoid action which would adversely affect the quality of the catch on board.
