Application of the principle of equal pay for men and women(debate).

That caselaw is accounted for by the existence also of Article 119 of the EC Treaty(Articles 117 to 120 of the EC Treaty were replaced by Articles 136 EC to 143 EC) and of a directive dedicated to the equal treatment of men and women in relation to pay, namely Council Directive 75/117/EEC of 10 February 1975 on the approximation of the laws of the Member States relating to the application of the principle of equal pay for men and women(OJ 1975 L 45, p. 19).
These amendments delete the reference to the concept of a"single source" to which pay differences can be attributed as developed by the Court of Justice, on the basis of the argument that the cases decided concerned specific circumstances that cannot be generalised and that the Court of Justice, unlike in the language of the proposal,used this concept only as a negative criterion to exclude the application of the principle of equal pay in the absence of a single source.
Whereas the principle of equal treatment was stated in Article 119 of the Treaty, in Council Directive 75/117/EEC of 10 February 1975 on the approximation of the laws of the Member States relating to the application of the principle of equal pay for men and women80 and in Council Directive 76/207/EEC of 9 February 1976 on the implementation of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion and working conditions81;
(16) The principle of equal pay for men and women is already firmly established by Article 141 of the Treaty and Council Directive 75/117/EEC of 10 February 1975 on the approximation of the laws of the Member States relating to the application of the principle of equal pay for men and women(11) and is consistently upheld by the case-law of the Court of Justice;

As regards Article 157 TFEU on the principle of equal pay, paragraph(3) of that Article provides for the adoption of“measures” in the ordinary legislative procedure to“ensure the application of the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation, including the principle of equal pay for equal work or work of equal value”.
Thus the proposals in this report include the proposal for urgent measures to be adopted for full andeffective application of Directive 75/117 EEC on the principle of equal pay for men and women as a means of opposing wage discrimination.
