Consideration of the draft Mining Code.
The agenda for the first part of the session shall be devoted to consideration by the Council of the draft mining code.
The Council began its consideration of the draft Mining Code at its 26th meeting, on 23 March 1998.
The Commission also requested the Secretariat to prepare a model contract for exploration based on the provisions of the draft mining code.
The ongoing negotiations on the draft Mining Code will hopefully yield good and comprehensive results.
The other important aspect relates to the elaboration of a draft Mining Code by the Authority.
First, the draft mining code being developed by the Authority is receiving close and careful scrutiny at the Council stage.
Several delegations suggested that the highest priority should be given to completing work on the draft mining code as soon as possible.
In accordance with the draft Mining Code, the contractor's programme of work during the exploration phase would be annexed as a schedule to the contract for exploration.
It made recommendations on the policy environment needed to promote investment in the sector and provided comments on a draft mining code.
Although some issues remain to be resolved,a number of the provisions of the draft mining code have in effect met with the approval of delegations.
Reporting Assessed and interpreted results of the monitoring shall be reported to theAuthority together with the data according to regulation 28 and annex 4, section 5.4, of the draft Mining Code.
The structure of the deliberations of the Council in its review of the draft mining code has permitted all members to voice their concerns.

The agenda for the second part of the session shall include, during the first week of the two-week session, the elections to the organs and offices of the Authority and the work of the Finance Committee andthe conclusion and adoption of the draft mining code;
The Council was informed that the Commission had reviewed the provisional text of the draft Mining Code, taking into account comments submitted by members of the Authority since the last session.
Among the matters to be considered by the Council during this part of the session were the agenda, election of the President and the Vice-Presidents,consideration of applications for extension of provisional membership of the Authority and consideration of the draft Mining Code.
By the end of the tenth session of the Preparatory Commission,Special Commission 3 had completed the first reading of the draft mining code on the basis of the working papers prepared by the Secretariat.
Perhaps most importantly, the International Seabed Authority has completed the arduous task of establishing its subsidiary bodies and an independent budget, andhas begun its substantive work with the approval of seven work plans for exploration and the consideration of a draft mining code.
The Legal and Technical Commission met during the first week of the session andcontinued work on the provisional text of the draft Mining Code prepared by the Commission during the third session ISBA/3/LTC/WP.1/Rev.3.
To advance the work of the Council on the draft mining code, the Secretary-General will consult with the incoming President of the Council and with the regional groups and interest groups with a view to identifying the main areas of difficulty in the draft code and the most efficient working method which would enable the outstanding issues to be resolved.
This report appraises the progress made to date in Special Commission 3 in the consideration of the various documents comprising the draft mining code. It also intends to shed light on the issues that require further consideration.
Notes with satisfaction the progress in the work of the International Seabed Authority, in particular the approval, during the third session of the Authority in 1997, of seven plans of work for exploration in the Area, and the progress being made by the Legal andTechnical Commission towards the formulation of a draft mining code;

The matters on the agenda for the sixth session include the election of the Presidents of the Assembly and the Council,consideration of the draft mining code, consideration of the staff regulations of the Authority and the election of one half the members of the Council in accordance with article 161, paragraph 3, of the Convention.
The secretariat received detailed comments from a number of members of the Authority and these,together with an annotated version of the draft mining code, were presented to the Legal and Technical Commission at its meeting in March 1998.
