The State party should ensure that the new Migration Code incorporates the definition of migrant worker set out in article 2 of the Convention, and is fully consistent with the rights recognized by the Convention to migrant workers in an undocumented or irregular situation.

The Committee urges the State party to ensure that the new draft Migration Code fully complies with the provisions of the Convention and includes a definition of migrant workers, including undocumented migrant workers, in conformity with the Convention, and to adopt it without delay.

El Comité insta al Estado parte a asegurarse de que el nuevo proyecto de código de migración se ajusta plenamente a las disposiciones de la Convención e incluye una definición de trabajadores migratorios, en particular trabajadores migratorios indocumentados, de conformidad con la Convención, y a aprobarlo sin demora.

The new migration code, which would facilitate migration procedures, was currently being examined by Parliament. Under the new code, procedures relating to the issue of work permits would be simplified and migrants married to Azerbaijani citizens would be able to seek employment without a work permit. Foreign workers would no longer be obliged to leave Azerbaijan for a period of 12 months once every five years.

Article 8 of the Labour Migration Law and the draft migration code provide for the payment of expenses by the legal entity or individual(employer) if a migrant worker and members of his or her family return to their country of origin in the event of early termination of the employment contract for reasons beyond the migrant worker's control.

En el artículo 8 de la Ley de migración laboral y en el proyecto de Código de Migración se establece el pago de los gastos de regreso del trabajador migratorio y sus familiares a su país de origen por parte de la persona jurídica o física(empleador) en caso de rescisión del contrato laboral antes del plazo por motivos ajenos al trabajador.
