Abandonment of seafarers.
The relevant instruments or declarations of the International Labour Organization, and other entities,concerning the abandonment of seafarers;
Problems related to the abandonment of seafarers in ports were highlighted by some delegations.
Among those problems are the smuggling of aliens by sea, illicit traffic in narcotic drugs, piracy andarmed robbery and the abandonment of seafarers.
It may be noted that the problem of abandonment of seafarers has recently been raised in the IMO Subcommittee on Flag State Implementation.
The report discusses such issues as wages, hours of work, food, accommodation and welfare,as well as such issues as gender and abandonment of seafarers.
The Database on Abandonment of Seafarers, set up in 2005 and operated by ILO, contains 40 reported cases of abandonment that occurred between January 2004 and November 2006.
In response to a need expressed by the IMO/ILO Ad Hoc Expert Working Group,ILO has developed a database of reported incidents of abandonment of seafarers.
Concerns have been raised over poor labour conditions on board some ships,incidents of abandonment of seafarers, the criminalization and detention of seafarers following maritime accidents, and restrictions on shore leave(see paras. 155-158 above) see A/60/63/Add.2, para. 28.
In that context,the resolution notes that the adoption of guidelines is an appropriate interim measure to ensure provision of financial security in case of abandonment of seafarers.
Proposed draft amendments to the Convention,covering the provision of financial security in case of abandonment of seafarers and treatment of contractual claims, will be submitted to the IMO Legal Committee in October 2009 and the November 2009 session of the Governing Body of ILO.
A joint IMO/ILO Ad Hoc Expert Working Group has been established to consider the subject of liability and compensation regarding claims for death,personal injury and abandonment of seafarers.
ILO reported that the Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers had held its second session from 30 October to 3 November 2000 for the report of the first session, see A/55/61, paras. 201-203.
Discussions are ongoing as to whether there is need for a mandatory solution to regulate liability and compensation regarding claims for death,personal injury and abandonment of seafarers.
Despite the low number of cases of abandonment currently registered in the joint database on abandonment of seafarers, some are of the view that broad conclusions could not be drawn since the maritime industry was currently in the midst of a very prosperous business cycle.36.
At its ninety-sixth session, the IMO Legal Committee reviewed the report of the ninth session of the Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers.
As a result of the work of the Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers, two important resolutions/guidelines were adopted by the IMO Assembly in November 2001.
The Open-ended Working Group may, furthermore, wish to consider requesting the Secretariat to consult the secretariat of the International Labour Organization,noting the work already undertaken by that organization regarding the abandonment of seafarers.
At its meeting in February 2008, the Joint IMO/ILO Ad Hoc Expert Working Group on Liability andCompensation regarding Claims for Death, Personal Injury and Abandonment of Seafarers committed itself to long-term mandatory solutions to the issues under its consideration.
The issue of abandoned ships has also been discussed by MEPC at its fifty-third and fiftyfourth sessions, by the IMO Legal Committee at its 91st session, as well as in the context of the Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers.
Having observed that ILO and IMO had established in recent years a number of joint working groups,such as those on fishing, the abandonment of seafarers, and safety and security in ports, he stated that ILO welcomed the establishment of the Joint Working Group, in which the Basel Convention would also participate.
It approved the Working Group's recommendation that an amendment to the 2006 Maritime Labour Convention would be the best way to create a mandatory instrument orinstruments on the issue of financial security in case of abandonment of seafarers and for contractual claims arising from sickness, injury or death.
Resolution A.930(22) on Guidelines on Provision of Financial Security in Cases of Abandonment of Seafarers states that abandonment of seafarers is a serious problem involving a human and social dimension and recognizes that, given the global nature of the shipping industry, seafarers need special protection.

The joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers, which met for the first time in October 1999(see A/54/429, para. 143), generally agreed that the problem of abandoned crew members was a serious one requiring urgent remedial action see also paras. 201-203 below.
Report of the fifth session of the Joint Working Group, in which the Group reiterated its request to Governments for reports on incidents of abandonment and for replies to the questionnaire concerning the monitoring andimplementation of guidelines on provision of financial security in case of abandonment of seafarers.
They provide background information concerning problems relating to claims resulting from the death orpersonal injury of seafarers and the problem of abandonment of seafarers, summarize the discussions by the Joint Working Group on these issues and set out the solutions proposed, including two joint resolutions aimed at IMO and ILO member States.
ILO has prepared proposals for both guidelines for these meetings. 83. Following on from the agreement during its seventh session to move to a mandatory long-term solution on the issue of abandonment, the Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers, during its eighth session in July 2008, committed itself to a mandatory long-term solution concerning claims for death and personal injury of seafarers. .
In March 2009, the Joint IMO/ILO Ad Hoc Expert Working Group on Liability and Compensation regarding Claims for Death,Personal Injury and Abandonment of Seafarers agreed to develop a comprehensive mandatory international mechanism to provide for the basic humanitarian needs of seafarers abandoned in foreign ports through an amendment to the ILO Maritime Labour Convention.
Indeed, it is likely to compound the problem, since the removal of such vessels from a register would be likely to occur under pressure of impending portState control detentions and therefore could result in the abandonment of seafarers in foreign ports see ICFTU submission to the Subcommittee on Flag State Implementation at its seventh session, FSI 7/9.
