The constitutional submission goes on to say that some of the organisers of public events interpret"in advance" literally,meaning that the corresponding bodies shall receive“notification" on the conduct of assemblies, meetings, rallies and demonstrations"prior” to the event.
In the context of issues raised in the constitutional submission, the provisions of the part 1 of Article 39 of the Constitution,relating to the advance notice on the conduct of assemblies, meetings, rallies and demonstrations to the executive authorities or bodies of local self-government, shall mean that the organisers of these events are obliged to notify these authorities in advance in the sense of doing it within the acceptable timeframe before the event.
Article 201 of the Administrative Liability Code establishes liability for failure to comply with the procedure for the organization and conduct of assemblies, meetings, street marches and demonstrations.
In the appeal, they noted that under Presidential Decree No. 11 on Certain Measures for Improvement of the Procedure for the Conduct of Assemblies, Rallies, Street Processions, Marches and other Mass Events in the Republic of Belarus of 7 May 2001, an authorization for a meeting was to be granted when a respective application was accompanied by[copies of] certificates and contracts concluded with state service providers that were to provide for the security of participants at the mass event in question.
While the Committee notes the enactment of a new law regulating public assemblies and processions,it is concerned about the conditions which the appropriate authorities may impose regarding the conduct of assemblies and processions upon receiving the required advance notification.
Organizers of mass meetings are responsible for complying with the provisions of the Law on the Organization and Conduct of Assemblies and other regulations on the prohibition of extremist activity and its timely combating.
At the same time, the Code lays down penalties in the form of fines, attachment of earnings for up to one year, ordeprivation of liberty for terms of up to two years for the organizers of such events who violate the procedure for the conduct of assemblies or demonstrations and whose negligence results in serious damage art. 347.
The Constitutional Count of Ukraine considered at its plenary session a case regarding official interpretation of the part 1 of Article 39 of the Constitution that requires advance notice on the conduct of assemblies, meetings, rallies and demonstrations to be submitted to the executive authorities or bodies of local self-government.
The actor for the purpose of constitutional submission- Ministry of Interior of Ukraine- addressed the Constitutional Court of Ukraine with request to provide an official interpretation of the part 1 of Article 39 of the Constitution relating to the advance notice on the conduct of assemblies, meetings, rallies and demonstrations to the executive authorities or bodies of local self-government.

The organizer of the assembly is responsible for complying with the provisions of the Law on the Organization and Conducting of Assemblies and regulations on the prohibition of extremist activity and its timely combating art. 13.
In April the leader of a Jehovah's Witnesses organization in Perm, Alexander Solov'ev, managed to annul a fine of a thousand rubles imposed under article 20.2 of the Code of Administrative Offenses(‘Violation of established procedure of an organization or the conducting of assemblies, meetings, demonstrations, marches or pickets') for conducting a church service in the Pushkin House of Culture in 2011.
