Governments are urged to implement fully andexpeditiously the Marrakesh Ministerial Decision on Measures in Favour of the Least Developed Countries.
Decision on Measures in Favour of Least-Developed Countries.
The measures contained in the Ministerial Decision on Measures in Favour of Least developed Countries were intended for the latter purpose.
Those proposals relate to the WTO waiver, Enabling Clause,Agreement on Trade-Related Investment Measures and the Decision on Measures in Favour of Least Developed Countries.
The Decision on Measures in Favour of LDCs further provides for a continued review of LDCs' problems and for a continued attempt to adopt positive measures to facilitate the expansion of their trading opportunities.
Concrete action is now called for towards the effective implementation of the UR Agreements and putting into effect the special anddifferential treatment provisions and the Decision on Measures in Favour of LDCs.
The implementation of the decision on measures in favour of LDCs would depend considerably on political will and constant monitoring, as well as on the provision of relevant technical assistance to LDCs.
At the multilateral level concerning trade, however, such assistance has so far been mentioned only for the least developed countries in the context of the Ministerial Decision on Measures in Favour of the Least Developed Countries.
Following the WTO Ministerial Decision on Measures in Favour of Least Developed Countries, preference-giving countries have made efforts to improve trade preferences for LDCs, both within and outside the framework of the GSP.
The Final Act of the Uruguay Round of multilateral trade negotiations, including the special clauses providing differential andmore favourable treatment, and the decision on measures in favour of least developed countries, provide the institutional framework for these matters.
With respect to the least developed countries, the Preamble, Article IV: 3, Article XIX:3, and the Decision on Measures in Favour of Least-Developed Countries provide that particular account shall be taken of their serious difficulties and that they will only be required to undertake commitments and concessions to the extent consistent with their individual development, financial and trade needs, or their administrative and institutional capabilities.
The Final Act of the Uruguay Round of multilateral trade negotiations, including the special clauses providing differential andmore favourable treatment, and the decision on measures in favour of least developed countries, provide the institutional framework for these matters.
Action by the international community,including increased technical assistance as foreseen in the Marrakesh Ministerial Decision on Measures in Favour of LDCs, complemented by adequate financial support, can help LDC efforts to increase export earnings through increased productionin both the traditional and the modern sectors of the economy, through diversification of the commodity structure and export markets, and thereby help to obtain better prices for their export commodities.
The Uruguay Round Agreements have to a certain extent responded to some of the above-mentioned concerns through special provisions in favour of the least developed countries, including the Ministerial Decision on Measures in Favour of the Least Developed Countries, adopted at Marrakesh in 1994.
These shortcomings may be mitigated by the commitment contained in the Ministerial Decision on Measures in Favour of Least Developed Countries(paragraph 2(iii)) which requires a flexible and supportive application of transitional provisions to LDCs.
The importance of fully andexpeditiously implementing the Marrakesh Declaration, the Ministerial Decision on Measures in Favour of Least Developed Countries and the Ministerial Decision on Measures Concerning the Possible Negative Effects of the Reform Programme on Least Developed and Net Food-Importing Developing Countries is stressed.
The representative of Egypt said that he did not share the view expressed by the representative of the European Union that the terms of reference limited the scope of the Working Group's work to the"decision on measures in favour of LDCs" referred to in the terms of reference as the"decision on special provisions.
UNCTAD's contribution to the work of relevant international organizations in the implementation of the Uruguay Round Final Act Decision on Measures in Favour of the Least Developed Countries by assisting the least developed countries that are members of the World Trade Organization to take maximum advantage of the special and differential measures provided for in the Uruguay Round agreements.

In view of LDCs' special economic situation and their development, financial and trade needs, WTO members should exercise restraint, where appropriate, in seeking concessions in the negotiations on market access for goods and services in keeping with the letter and spirit of the provisions of the Ministerial Decision on Measures in Favour of the Least Developed Countries;
Viii Contributing, as appropriate, to the work of relevant international organizations in the implementation of the Marrakesh Ministerial Decision on Measures in Favour of the Least Developed Countries by assisting the least developed countries that are WTO members to take maximum advantage of the special and differential measures provided for in the Uruguay Round Agreements;
The WTO Third Ministerial Conference should take concrete actions in the areas of guaranteed and duty-free market access for products from developing countries,full implementation of the Marrakesh Declaration and Ministerial Decision on Measures in Favour of the Least Developed Countries as well as special and differential treatment of such countries as an integral part of the multilateral trading system, including measures to facilitate trade.
Action by the international community, including increased technical assistance as foreseen in the Marrakesh Ministerial Decision on Measures in Favour of LDCs, complemented by adequate financial support, can help LDC efforts to increase export earnings through increased production in both the traditional and the modern sectors of the economy, through diversification of the commodity structure and export markets, and thereby help to obtain better prices for their export commodities.
Such support relates primarily to the implementation of Uruguay Round agreements as they concern the least developed countries, viz., full andexpeditious implementation of the Marrakesh Declaration as it relates to the least developed countries and the Ministerial Decision on Measures in favour of least developed countries, as well as giving effect to the Ministerial Decision on measures concerning the possible negative effects of the reform programme on the least developed countries and net food importing countries.
The provisions on special and differential treatment for LDCs and developing countries(DCs)in the various Agreements and in the Decision on Measures in Favour of Least Developed Countries guarantee DCs/LDCs partial or total exemptions from some UR commitments and provide a flexible means by which LDCs(and DCs) would, after a specified transitional period, assume full WTO obligations(see table 2), taking into consideration their special development needs born out of their structural weaknesses.
