Decriminalization of defamation and similar offences.
Recommendation 6 on the decriminalization of defamation.
Decriminalization of defamation- libel is no ore the crime punishable by the criminal law;
The Special Rapporteur wishes to endorse efforts toward the decriminalization of defamation and similar offences.
JS4 recommended the decriminalization of defamation by abolishing relevant articles of  the Criminal Code.
It expressed concern about the deterioration in press freedom but welcomed the decriminalization of defamation.
Third, legal measures should be taken, such as the decriminalization of defamation and the elimination of  all forms of  censorship.
UNESCO, noting that defamation  law is still employed, which may result in self-censorship,recommended the decriminalization of defamation.
UNCT stated that the accepted UPR recommendations on decriminalization of defamation had yet to be fully implemented.
In addition to the decriminalization of defamation, fines following a guilty verdict in civil proceedings are now seen as more proportionate.
An encouraging trend can be observed in various parts of  the world towards the decriminalization of defamation and related offences.
UNESCO recommended decriminalization of defamation and investigation into reports of  attacks on journalists to ensure that perpetrators were brought to justice.

Belgium commended progress since the first UPR cycle,including the ratification of  various human rights instruments and the decriminalization of defamation.
Despite the decriminalization of defamation in June 2011,defamation  suits continued to be brought against journalists, in many instances by public officials.
The Committee recalls its general comment No. 34(2011) on freedoms of  opinion andexpression and urges the State party to consider the decriminalization of defamation.
The decriminalization of defamation has increased the realm of  freedom of  expression and helped judges to be more liberal in their sentences against media.
Ireland noted the adoption of  legislation on discrimination, albeit not explicitly protecting LGBT persons, the decriminalization of defamation and the visits by two special procedures mandate holders.
The issue of  the decriminalization of defamation and similar offences has been comprehensively discussed at international meetings at which experts drafted principles and guidelines for action.
Recommendation 135.74- Equatorial Guinea agrees to adopt measures to guarantee freedom of  the press in line with international standards, butdoes not agree to the decriminalization of defamation.
UNESCO noted that blasphemy was considered a criminal offence punishable by death and encouraged the decriminalization of defamation to make it part of  the civil code in accordance with international standards.
Mr. O'Flaherty(Rapporteur for the general comment) pointed out that it was a relativelymild recommendation rather than a requirement, namely:"States parties should consider the decriminalization of defamation.
During my meetings, I welcomed the positive steps that Georgia has already undertaken, especially regarding decriminalization of defamation and the financing of  the Public Service Broadcaster, but I also expressed my hope that the reform process will continue.
B2 Measures are still required(i) to ensure the implementation of  the laws adopted and measures taken by the Prosecution Service and(ii)to guarantee decriminalization of defamation in all federal states.
The decriminalization of defamation and insult in 2010 had been a big step forward, however, the courts' had made journalists pay the maximum amounts of  compensation under the Civil Code and this policy had imposed a financial burden upon newspapers.
In order further to enhance freedom of  expression,PIC called for the adoption of  legislation covering freedom of  information and the decriminalization of defamation, consistent with accepted international democratic standards etc.
States parties should consider the decriminalization of defamation and, in any case, the application of  the criminal law should only be countenanced in the most serious of  cases and imprisonment is never an appropriate penalty.
Mr. O'Flaherty(Rapporteur for the general comment) said that the United States and a large number of  NGOs had welcomed the recommendation in the seventh sentence that States parties should consider the decriminalization of defamation.
The representative of  Montenegro stated that insults and libel had been decriminalized, andalso pointed out that the decriminalization of defamation was crucial for aligning national laws with international standards and for journalists to carry out their work effectively.
The Ombudsman reported that decriminalization of defamation had contributed to a reduction in the number of  cases prosecuted against media and the courts started to apply regional practice and Montenegro's Supreme Court's guidance in determining compensation for non-material damage.
