This reflection also benefited from a certain number of meetings, in particular with a group of experts mandated by the High Representative for Bosnia and Herzegovina, and from visits andmeetings with all involved parties in Sarajevo and in the two entities of Bosnia and Herzegovina, the Federation and the Republika Srpska.
Taking note also of the final decision of 5 March 1999 of the arbitration tribunal on Brcko and noting the obligation of the Federation andRepublika Srpska entities of Bosnia and Herzegovina to implement the award fully, including with respect to enabling minority refugee returns in both entities. .
The Committee is also deeply concerned that in spite of the guarantees in the Peace Agreement, annex 7, concerning the right of all refugees and displaced persons to freely return to their homes of origin,serious obstacles to return continue to exist in Bosnia and Herzegovina, and that property laws which conflict with the Peace Agreement remain in effect in the two principal entities of Bosnia and Herzegovina.
With the help of experts from the Council of Europe, an effort was being made to align the constitutional provisions of the two component entities of Bosnia and Herzegovina with those of the national Constitution.
Existing agreements between the Federal Republic of Yugoslavia and the Republika Srpska and between the Republic of Croatia and the Republic of the Federation of Bosnia andHerzegovina establishing special parallel relationships between the Entities of Bosnia and Herzegovina and the neighbouring States, suffered from constitutional shortcomings.
Meanwhile, in Republic of Srpska, another entity of Bosnia and Herzegovina(BiH), only a few, small, non-violent protests were organised.
Those arrests were made with the cooperation of Governments in the region: Serbia andthe Republika Srpska, an entity of Bosnia and Herzegovina, assisted in the apprehension of Tolimir and Serbia and Montenegro assisted with the arrest of Vlastimir Dordevič.
The Secretary-General further indicates that this entity of Bosnia and Herzegovina has done little or nothing to erase the effects of“ethnic cleansing” and for the return of the refugees to their homes.
It called on the Security Council to ensure the compliance by the Federal Republic of Yugoslavia(Serbia and Montenegro) andthe Republika Srpska entity of Bosnia and Herzegovina with the orders of the International Criminal Tribunal for the Former Yugoslavia.
