Progress report on establishment of the Extraordinary Chambers for the Prosecution under Cambodian Law of Crimes Committed During the Period of Democratic Kampuchea.
In accordance with the Agreement between the United Nations andthe Royal Government of Cambodia concerning the prosecution under Cambodian law of crimes committed during the period of Democratic Kampuchea, the internal rules had been drafted on the basis of Cambodian procedural law(including the draft Penal Procedure Code, which, when adopted, will replace current criminal procedure), with modifications where there were omissions or uncertainty in Cambodian procedural law, or where existing law failed to comply with international standards.

Since the issuance of the report of the Secretary-General of 12 October 2004 onthe Khmer Rouge trials(A/59/432) and its addendum dated 29 November 2004(A/59/432/Add.1), there has been substantial progress towards the establishment of Extraordinary Chambers for the Prosecution under Cambodian Law of Crimes Committed during the period of Democratic Kampuchea.
The issues included the potential impact on the Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea, as well as the budgetary implications involved in creating a second panel, including the need for new support staff in the Trial Chambers.
In his subsequent reports onthe Khmer Rouge trials(A/58/617, A/59/432 and Add.1, A/60/565 and A/62/304), the Secretary-General provided information on the progress achieved towards establishing and operating the Extraordinary Chambers in the Courts of Cambodia, within the Cambodian domestic courts, for the prosecution under Cambodian law of crimes committed during the period of Democratic Kampuchea.
The Agreement between the United Nations and the Cambodian Government concerning the prosecution under the Cambodian law of crimes committed during the period of Democratic Kampuchea was signed in Phnom Penh on 6 June 2003.
In his subsequent reports on the Khmer Rouge trials(A/58/617, A/59/432 and Add.1, A/60/565, A/62/304 and A/67/380), the Secretary-General provided updates on the progress achieved towards establishing and operating the Extraordinary Chambers in the Courts of Cambodia, within the Cambodian domestic courts, for the prosecution under Cambodian law of crimes committed during the period of Democratic Kampuchea.
In accordance with article 7(4) of the Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea, the investigation was therefore to proceed, and the international co-prosecutor's introductory submission was transmitted to the co-investigating judges on 7 September 2009.
On 28 April 2005 a notification was sent to the Government of Cambodia indicating that the legal requirements on the United Nations side for the entry into force of the Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea, done at Phnom Penh on 6 June 2003, had been complied with.
By its resolution 57/228 B, of 13 May 2003, the General Assembly approved the draft Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea and urged the Secretary-General and the Government of Cambodia to take all measures necessary to allow the agreement to enter into force and to implement it fully thereafter.
Welcoming the efforts of the SecretaryGeneral and the Royal Government of Cambodia to conclude the negotiation of the draft Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution.
In response to that decision, on 20 January, the Secretary-General issued a statement referring to article 5(6) of the Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea, which stated that, in case there was a need to fill the post of the international co-investigating judge, the person appointed to fill that post must be the reserve international co-investigating judge.
During 2003, the OHCHR also supported the relevant authorities to ensure that the National Assembly election was conducted in a free, informed and fair manner. The agreement between the United Nations andthe Government of Cambodia concerning the prosecution under the Cambodian law of crimes committed during the period of Democratic Kampuchea was signed in Phnom Penh on 6 June 2003.
The present report provides details on the progress achieved in preparing for the entry into force and implementation of the Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea, addresses the issue of resource requirements and resource mobilization and outlines the next steps to be taken in preparing for the entry into force and implementation of the Agreement.
Recalls article 15 of the Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea of 6 June 2003;
Approves the draft Agreement between the United Nations andthe Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution;
After many years of negotiation, an agreement between the United Nations andthe Government of Cambodia concerning the prosecution under Cambodian law of crimes committed during the period of Democratic Kampuchea was signed in Phnom Penh on 6 June 2003.
