Article 4- Measures derogating from the obligations under the Covenant.
Article 4, paragraph 1, of the Covenant stipulates that in time of public emergency States parties may take measures derogating from certain of their obligations under the Covenant.

The HR Committee recommended, inter alia,that Grenada provide detailed information on the way it ensures that measures derogating from its obligations under ICCPR do not involve discrimination on the grounds of race, colour, sex, language, religion and social origin.
Under article 4 of the Covenant, measures derogating from obligations set out therein can only be taken to the extent strictly required by the exigencies of the situation, and only in time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed.

A State party may take measures derogating from its obligations under the International Covenant on Civil and Political Rights pursuant to article 4(hereinafter called“derogation measures”) only when faced with a situation of exceptional and actual or imminent danger which threatens the life of the nation.
