The judges of both the first and second instance courts unjustly accepted the evidence of an individual, on which his conviction was largely based, who it was acknowledged was supposed to have been an accomplice to the crime but who had been pardoned.
It reiterates the efforts made by the State party to expressly incorporate the access to a second instance court for all the judgements, namely through the Organic Act of Development of Fundamental Rights Related to Criminal Proceedings and a new Criminal Procedure Act.
