The right of access to documents.
Following the principles of the Regulation(EC) No 1049/2001, citizens of the EU have a right of access to documents of the institutions.
Article 42 Right of access to documents.
Any citizen of the EU, and any natural or legal person residing or having its registered officein a Member State, is to have a right of access to documents of the European Central Bank(ECB).

It must be recalled that according to the fourth recital andArticle 1 thereof, the purpose of Regulation No 1049/2001 is to give the public the fullest possible right of access to documents held by the institutions.
Article 42- Right of access to documents.
Regulation No 1049/2001 determines the general principles and the limits which, for reasons of public orprivate interest, govern the exercise of the right of access to documents, in accordance with Article 255(2) EC.
That list shall not restrict the right of access to documents not falling within the categories listed;

The right of access to documents of the institutions, bodies, offices and agencies of the EU(Article 42);

Whereas the right of access to documents held by EU institutions, including EU agencies, is an important right, exceptions to which are to be interpreted narrowly;
It is thus designed to facilitate as far as possible the exercise of the right of access to documents, and to promote good administrative practices.
This list shall not restrict the right of access to documents not falling within the categories listed; those documents shall be made available on written application.
The Board of Regulators shall adopt, on behalf of BEREC,the special provisions on the right of access to documents held by BEREC, in accordance with Article 27.
In accordance with Article 52(2)of the Charter, the right of access to documents is exercised under the conditions and within the limits for which provision is made in Article 15(3) of the Treaty on the Functioning of the European Union.
Furthermore it also foresees that any citizen of the Union, and any natural or legal person residing or having its registered office in a Member State,must have a right of access to documents of the Union's institutions, bodies, offices and agencies.
Last but not least, citizens must be granted a right of access to documents of the European Institutions within the necessary limitations laid down in Regulation(EC) No 1049/2001.
It is apparent from the very wording of Article 255 EC that it refers only to the right of access to documents of the European Parliament, of the Council and of the Commission.
As regards the right of access to documents, on 17 December 2009 Parliament adopted a resolution on improvements needed in the legal framework for access to documents following the entry into force of the Lisbon Treaty.
Article 15(3) of the TFEU gives every natural orlegal person in a Member State the right of access to documents of the Union's institutions, bodies, offices and agencies.
The Treaty of Lisbon also reasserts the right of access to documents by natural or legal persons, while nevertheless ensuring that regulations with criteria and limitations in line with the characteristics of each body will be established.
Any citizen of the Union, and any natural or legal person residing or having its registered office in a Member State,has a right of access to documents of the institutions, bodies, offices and agencies of the Union, whatever their medium.
Article 42(“Right of Access to Documents”) from the Charter of Fundamental Rights in the European Union acknowledges the right of information upon“documents of the institutions, bodies, offices and agencies of the Union, whatever their medium”.
Article 2(1) of Regulation No 1049/2001 provides that any citizen of the Union has a right of access to documents of the institutions, subject to the principles, conditions and limits defined in that regulation.
Any natural or legal person or any association of legal ornatural persons shall have a right of access to documents of the Union institutions, bodies, offices and agencies, subject to the principles, conditions and limits defined in this Regulation.
(SK) Based on experience in the Member States,the EU has started to recognise a real'right of access to documents' and'right to information' arising from the principles of democracy, transparency, public interest and openness.
