(SK) Based on experience in the Member States,the EU has started to recognise a real'right of access to documents' and'right to information' arising from the principles of democracy, transparency, public interest and openness.
As regards the right of access to documents, on 17 December 2009 Parliament adopted a resolution on improvements needed in the legal framework for access to documents following the entry into force of the Lisbon Treaty.
General principles and limits on grounds of public orprivate interest governing this right of access to documents shall be determined by the European Parliament and the Council, by means of regulations, acting in accordance with the ordinary legislative procedure.

The volume of access requests andthe high rate of disclosure of documents show that the right of access to documents is actively used by EU citizens and has resulted in a large number of documents being made available, in addition to the extensive documentation already available on the Commission's website.
The Treaty of Lisbon also reasserts the right of access to documents by natural or legal persons, while nevertheless ensuring that regulations with criteria and limitations in line with the characteristics of each body will be established.
In paragraphs 55 to 58 of that judgment, it stated that the right of access to documents of the institutions is connected with the democratic nature of those institutions and that, since the purpose of Regulation No 1049/2001 is, in accordance with Article 1 thereof, to ensure the widest possible right of access, the exceptions to disclosure must be interpreted and applied strictly.
We remain convinced of the need to promote the right of access to documents by natural and legal persons, in the knowledge that we must define a reasonable principle to balance conflicting needs: extending the role of the European Ombudsman, setting out precise and appropriate criteria for access and introducing transitional arrangements which will gradually lead to rules in line with citizens' needs, compatible with the proper functioning of the institutions.
This Regulation is without prejudice to existing rights of access to documents for Member States, judicial authorities or investigative bodies.
