National authorities andthe EU Commission will coordinate common actions to stop“'widespread infringements with a Union dimension”.

Coordinated actions against widespread infringements should ensure that competent authorities may choose the most appropriate and efficient tools to stop widespread infringements and to ensure consumer compensation.
(11)Member States should not beprevented from maintaining or introducing in their national law higher maximum turnover-based fines for widespread infringements and widespread infringements with a Union dimension of consumer law, as defined in Regulation EU 2017/2394.
(4) Member States shall ensure that the penalties for widespread infringements and widespread infringements with a Union dimension within the meaning of Regulation(EU) No 2017/2934 include the possibility to impose fines, the maximum amount of which shall be at least 4% of the trader's annual turnover in the Member State or Member States concerned.
Furthermore, Article 21 of Regulation(EU) 2017/2394 40 on consumer protection cooperation(CPC) requires Member States to take enforcement measures, including imposition of penalties, in an effective, efficient andcoordinated manner to bring about the cessation or prohibition of widespread infringements or widespread infringements with a Union dimension.
Member States shall ensure that the penalties for widespread infringements and widespread infringements with a Union dimension within the meaning of Regulation(EU) 2017/2934 include the possibility to impose fines, the maximum amount of which shall be at least 8% of the average turnover generated by the trader in the preceding three financial years in the Member State or Member States concerned.
Other important provisions of the draft Directive on better enforcement andmodernisation include stronger powers for the enforcement authorities to impose deterrent sanctions for widespread infringements that are subject to EU coordinated enforcement actions and stronger rights for consumers to compensation and other remedies when they are victims.
Member States shall ensure that the penalties for widespread infringements and widespread infringements with a Union dimension within the meaning of Regulation(EU) No 2017/29394 include the possibility to impose fines, the maximum amount of which shall be at least 4% of the trader''s annual turnoveglobal turnover calculated on the basis of the total turnover for the previous year in the Member State or Member States concerned.
To ensure that Member States' authorities can impose effective,proportionate and dissuasive penalties in relation to widespread infringements and to widespread infringements with a Union dimension that are subject to coordinated investigation and enforcement measures in accordance with Regulation(EU) 2017/2394, fines should be introduced as an element of penalties for such infringements. .
(4) Member States shall ensure that the penalties for widespread infringements and widespread infringements with a Union dimension within the meaning of Regulation(EU) No 2017/2934 in the case of activities that are actively pursued with a cross-border orientation by the trader include the possibility to impose fines, the maximum amount of which shall be at least 4% of the trader's annual turnover in the Member State or Member States concerned.
Where appropriate, they shall impose penalties, such as fines or periodic penalty payments,on the trader responsible for the widespread infringement or the widespread infringement with a Union dimension.
(6b)'Mass harm' means a widespread infringement with a Union dimension by traders of provisions of the Union law listed in Annex I that harm or may harm the collective interest of a considerable number of consumers.
(6b)‘widespread infringement with a Union dimension' means a widespread infringement that has done, does or is likely to do harm to the collective interests of consumers in at least two-thirds of the Member States, accounting, together, for at least two-thirds of the population of the Union.
(ca)'widespread infringement with a Union dimension' means a widespread infringement that harmed, harms or is likely to harm consumer's collective interests in a majority of Member States accounting together for at least a majority of the population of the Union;
