The fight against illegal operators calls for effective enforcement measures.
The Member States should beencouraged to exchange best practice on combating illegal operators.
Illegal operators usually employ clandestine and international methods in order to disguise their activities.
The Member States should be encouraged toexchange best practices in the area of combating illegal operators.
However, for that to happen we must fill the gaps enabling illegal operators to profit from their activities.
Illegal operators within EU waters also take advantage of the weakness of the control, inspection and enforcement systems of Member States to develop their activities.
As regards the distinction between non-authorised and illegal operators, reference should be made to Footnote 15 in the communication.
This will help consumers identify regulated EU authorised operators abiding by EU minimum standards of consumer protection andavoid illegal operators.
Unscrupulous illegal operators take advantage of those weaknesses to pursue fishing activities without authorization from the coastal States and to plunder resources which are vital to local fishermen.
International trade in fisheries products has grown considerablyas part of the economic globalization, and this has provided illegal operators with many lucrative new opportunities.

In view of the specific features of this sector and the changes involved with internet use, the Committee believes that action by the EU should take the form of sustained cooperation between the Member States andthe promotion of best practices in combating illegal operators, which requires transnational action.
Hence the need for robust measures tobe pinpointed in each Member State to stamp out illegal operators that are in breach of national legislation, which is the primary and best guarantee for the protection of consumers.
However, the Committee would like to see more effective legislative instruments- preferably directives- being used in certain areas, where there is concurrent competence, to protect consumers and the most vulnerable groups,and to combat illegal operators and money laundering;
The Committee stresses that action in thisarea should include measures to counter illegal operators such as banning advertising by operators that are providing services without a license in the country where the consumer resides.
While supporting the initiatives proposed by the Commission, especially as regards effective cooperation between Member States, the Committee would like to see more effective instruments- preferably directives- being used in certain areas(see point1.8) to protect consumers and the most vulnerable groups, and to combat illegal operators and money laundering.
While costs are low, the probable profits from IUU activities are generally high,in particular since illegal operators tend to target valuable species which command higher market prices for example, toothfish, bluefin tuna or cod.

Since such counterfeit and pirated goods are, by definition, substitutes in the economic sense for the lawfully marketed goods which they imitate,the divergences in the cost base in the Internal Market for illegal operators will also give rise to differences in the conditions of competition for the lawful operators. .
The persistence of IUU practicesis to a large extent the consequence of the ease with which illegal operators are able to pursue their activities throughout the whole supply chain, unhampered by any kind of obligation or constraint which might interfere with their practices.

This action should be complemented by measures to combat illegal operators such as the publication of black and/or white lists drawn up by national regulatory authorities to enable consumers to distinguish more easily to distinguish illegal sites from between authorised ones, by displaying the logo of the national regulatory authority on the homepage of betting sites, unauthorised and illegal sites.
Typical examples include fraudulent"lottery scams", where an unlicensed illegal operator contacts consumers asking them to pay an amount of money(handling fee) or give personal information(bank details) before a prize can be paid.
