The Guarantee Section shall finance.

Whereas, since the provisions laid down in this Regulation concern the EAGGF, Guarantee Section, the expenditure covered by Community co-financing should be regarded as intervention within the meaning of Article 3 of Regulation(EEC) No 729/70.

The amounts shall be credited to the account of the European Agricultural Guidance and Guarantee Fund(EAGGF), Guarantee Section.
Article 40(4) of the Treaty and the relevant provisions for the implementation of Article 40 shall,so far as the Guarantee Section of the European Agricultural Guidance and Guarantee Fund is concerned, apply to the French overseas departments in respect of the products referred to in Article 1.
The amounts recovered shall be paid to the disbursing agency andshall be deducted from the expenditure financed by the EAGGF, Guarantee Section.
The Guarantee Section is used to finance the common organisation of agricultural markets(direct payments, export refunds, intervention buying-in), certain types of expenditure in the veterinary and phytosanitary sectors, and measures to evaluate and provide information on the Common Agricultural Policy.
(e) measures intended to provide information on the common agricultural policy andcertain evaluation actions of measures financed by the Guarantee Section of the Fund.
Community action through the Structural Funds, the Cohesion Fund,the European Agricultural Guidance and Guarantee Fund(EAGGF), Guarantee Section, the European Investment Bank(EIB) and the other existing financial instruments shall support the achievement of the general objectives set out in Articles 158 and 160 of the Treaty.
Any securities forfeit and penalties imposed shall be deducted from the expenditure part-financed by the Community anddeclared to the EAGGF Guarantee Section.
(1) Since modern financial audit methodsare becoming increasingly important in the EAGGF Guarantee Section accounts clearance procedure, the conciliation body should be composed not only of members who are highly qualified in EAGGF Guarantee Section matters, but also of members with a high level of practical financial audit experience.
The difference between the buying-in price and the selling price for such alcohol should be borne, at a standard rate,by the European Agricultural Guidance and Guarantee Fund(EAGGF) Guarantee Section.

Member States shall, at regular intervals, transmit to the Commission the following information concerning the accredited paying agencies and coordinating bodies andrelating to the transactions financed by the Guarantee Section of the Fund.
(10) Current feasibility studies should be continued to determine whether it is technically possible toestablish a database on aid paid by the EAGGF(Guarantee Section) and what resources would be required to do so.
The 2003 reform is an unmistakable step forward which ought to help our agricultural sector protect the environment and health, and it was in this spirit in 2005 that we voted in favour of thenew EAFRD Regulation replacing the EAGGF- Guarantee section.
Whereas the general rules for Community financing of interventions should be embodied in a single Regulation; whereas Council Regulation(EEC) No 2824/72 of 28 December 1972laying down general rules for the financing of interventions by the Guarantee Section of the European Agricultural Guidance and Guarantee Fund(4) should be repealed.
Commission Regulation(EC) No 447/2004 provided rules to facilitate the transition from support under Sapard to the financing after accessionby the European Agricultural Guidance and Guarantee Fund(EAGGF) Guarantee Section.
Whereas the conclusions of the European Council of 11, 12 and 13 February 1988 provided for the creation, in the Community budget, of a monetary reserve, hereinafter referred to as the'EAGGF monetary reserve', to offset the impact of significant andunforeseen fluctuations in the ECU/dollar parity on the expenditure under the Guarantee Section of the European Agricultural Guidance and Guarantee Fund(EAGGF); whereas that reserve should be covered by specific provisions;
(6) Article 36(1) of Regulation(EC) No 1257/1999 provides that Regulation(EC) No 1260/1999 and the provisions adopted in implementation thereof apply, save as otherwise provided for under Regulation(EC) No 1257/1999, to rural development measures in areascovered by Objective 2 financed by the EAGGF(Guarantee section).
To that end, Commission Decision 94/442/EC of 1 July 1994 setting up a conciliation procedure in the context of the clearance of the accounts of the European Agricultural Guidance andGuarantee Fund(EAGGF) Guarantee Section(2), as last amended by Decision 2000/649/EC(3).
(1) Article 1 of Regulation(EC) No 723/97(3) provides for the Community to contribute towards costs incurred by Member States in implementing new action programmes, arising out of new Community obligations, approved by the Commission and aimed at improving the structures oreffectiveness of EAGGF Guarantee Section expenditure controls.

The part-financing of the measures referred to in Article 1 and the aid provided for in Article 3 shall be regarded as intervention measures intended to stabilize the agricultural markets pursuant to Article 3(1) of Council Regulation(EEC) No 729/70(4). They shallbe financed from the European Agricultural Guidance and Guarantee Fund(EAGGF), Guarantee Section.
