The Commission wouldlike to recall that the legal framework governing the implementation of financial instruments has developed significantly over time(e.g. the provisionsof the Financial Regulation governing financial instruments have become very sophisticated and detailed, which in turn requires more efforts and know-how on the side of the implementing partner).
Given that there is a plan for the implementation of financial instruments in the fishing operational programme, the Commission supports the creation of such financial instruments in order to set up key measures for the operational programme, providing these comply with the legal provisions on the subject, in particular, Articles 34 and 37 of Regulation(EC) No 498/2007.
The Commission encourages and supports the setting-up and implementation of financial instruments co-financed by the European Structural and Investment Funds through the Financial Instruments- Technical Advisory Platform(FI-TAP) and other joint instruments with the EIB Group.

In order to expedite implementation of financial instruments combining support from the ESI Funds with EIB financial products under the EFSI's EU guarantee and to provide a continuous legal basis for the signature of funding agreements allowing for use of escrow accounts for equity-based instruments, it is necessary for some of the amendments to this Regulation to apply with effect from 1 January 2018.
