The consent does not concern specific measures implementing enhanced cooperation.

Concerning the regulation implementing enhanced cooperation, the ministers approved a general approach to the key elements and requested that issues pending be examined afresh.
The procedure for determining the law applicable is laid down in Council Regulation(EU)No 1259/2010 of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation(Rome III Regulation).

In cross‑border divorce cases the law that is applicable is determined in accordance with Council Regulation(EU)No 1259/2010 of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation.
Having regard to the proposal for a Council Regulation implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements(COM(2011)0216).
In the context of this plea, the Kingdom of Spain bases its arguments on the language arrangements for the unitary patent and, in particular,on the Proposal of 13 April 2011 for a Council regulation implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements.
The Council agreed on a general approach for implementing enhanced cooperation in the area of the creation of unitary patent protection, which will be valid throughout the territories of the participating member states.
To determine the law applicable to international private-law relations, the Romanian court will apply either Council Regulation(EU)No 1259/2010 of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation or Article 2957 and subsequent articles of the Civil Code.
Moreover, the content of the Commission's proposal implementing enhanced cooperation is limited by the scope specified in the participating Member States' requests for enhanced cooperation, i.e. applicable law in matrimonial matters.
Introducing a new definition of Member State for the purpose of this Regulation is important, so as to cover only Member States participating in the Matrimonial Property Regulation, in line with the definition included in Article 3(1) of Council Regulation(EU)No 1259/2010 of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation(Rome III).
The Kingdom of Spain seeks, in reality,to challenge the legality of the future Council regulation implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements.
The situation regarding matrimonial property regimes and the property consequences of registered partnerships will thus be equivalent to the situation regarding other civil justice instruments in which not all Member States participate,such as Regulation No 1259/2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation and Regulation No 650/2012 on succession and wills.
In that respect, it cites Article 1 of the Commission'sproposal of 13 April 2011 for a regulation implementing enhanced cooperation in the area of the creation of unitary patent protection, which provides that that regulation is to constitute a special agreement within the meaning of Article 142 of the EPC.

Alternatively, annul Articles 4, 5, 6(2), and 7(2)of Council Regulation No 1260/2012 of 17 December 2012 implementing enhanced cooperation in the area of the creation of unitary patent protection with regard to the applicable translation arrangements and order the Council to pay the costs.

Furthermore, the application of the regulations on matrimonial property regimes andthe property consequences of registered partnerships implementing enhanced cooperation will not depend on the nationality of the members of the couple, that is, on whether or not the members of the couple are nationals of a participating Member State.
