Draft guideline 2.6.1 Definition of objections to reservations.
The Commission had not yet concluded its discussion of the draft guideline concerning the definition of objections to reservations.

At its fifty-fifth session,the Commission considered chapter II of the eighth report on reservations to treaties concerning the definition of objections to reservations.
One member stressed that no formal link should be established between the definition of objections to reservations and the effects provided for in the Vienna Conventions;
The definition of objections to reservations, if there was any need for one, should include all the negative reactions that a State might have concerning reservations, whether with regard to the content or the fact that they were late.
Several delegations commented on the definition of objections to reservations.
In addition, it had revised the definition of objections to reservations given in guideline 2.6.1 in order to take account of the variety of effects which an objection might be intended to produce.
As for draft guideline 2.6.2("Objection to the late formulation of widening of the scope of a reservation"), the text of which was also acceptable,it could be included in the definition contained in draft guideline 2.6.1"Definition of objections to reservations.
In chapter II of his eighth report, the Special Rapporteur proposed a definition of objections to reservations in order to fill a gap in the 1969 and 1996 Vienna Conventions, which do not contain such a definition. .
The definition of objections to reservations that had been proposed by the Special Rapporteur in Chapter II of his eighth report was too narrow in describing the legal effects of objections since it did not take State practice on that issue into account.
At its 2822nd meeting,held on 23 July 2004, the Commission decided to refer draft guidelines 2.6.1"Definition of objections to reservations" and 2.6.2"Objection to the late formulation of widening of the scope of a reservation" to the Drafting Committee.
The definition of objections to reservations proposed by the Special Rapporteur in chapter II of his eighth report(A/CN.4/535/Add.1) was acceptable, because it was based on the Vienna Conventions and broad enough to cover a miscellany of intentions on the part of States or international organizations.
Turning to chapter X, on reservations to treaties,he said that the Commission had adopted two draft guidelines, on the definition of objections to reservations and the definition of objections to the late formulation or widening of the scope of a reservation. .

The Commission had also decided to revise the definition of objections to reservations given in guideline 2.6.1, in order to take account of the variety of effects which an objection might be intended to produce.
The Special Rapporteur's definition of objections to reservations was acceptable; the legal effects of an objection to a reservation should be determinable from the intention of the objecting State, and that intention should thus be clearly and unequivocally formulated.
The Commission also adopted two draft guidelines dealing with the definition of objections to reservations and the definition of objection to the late formulation or widening of the scope of a reservation together with commentaries Chap. X.
