Equality of spouses; equal rights to require divorce.
Article 32 of  the Constitution guarantees the equality of spouses in family relations.
The equality of spouses means the prohibition of  any discrimination.

The equality of spouses is a general principle of  the civil law embodied in Article 1.2 of  the Civil Code of  the Republic of  Lithuania, which is implemented in the family law.
The author considers that this situation is in breach of  his right to equality of spouses under article 23, paragraph 4, of  the Covenant.

Article 1 of this code provides that,"marriage, as a legal cohabitation is based on juridical and moral equality of spouses, in love, respect and mutual understanding, as the basis of  family unity.
The basic principles of  the Croatian Citizenship Act are: exclusivity of  Croatian citizenship, legal continuity of  citizenship, prevention of  statelessness,equality of  children born in or outside of  wedlock and equality of spouses.
Pursuant to article 1 of  this Code"marriage is a legal cohabitation, based on moral and juridical equality of spouses, on the feelings of  love, respect and mutual understanding, as the unity basis in the family.
The New Family Code, was approved after a long several-year work by Law No. 9062, of  08.05.2003. The family Code, when defining marriage, declares the moral and legal equality of spouses as basic and important living principles.
The Committee has also recommended that States raise awareness about the equality of spouses or guardians in their right to apply and collect passports or birth certificates on behalf of  their children without the need for the spouses' written consent.
The notification specified that the withdrawal was effected because the existing discriminatory provisions against women in the rules governing property rights arising out of  a matrimonial relationship andthose concerning the legal administration of  the property of  children had been abrogated by Act No. 85-1372 of  23 December 1985 concerning equality of spouses in respect of  property rights arising out of  a matrimonial relationship and equality of  parents in respect of  the property of  minor children, which entered into force on 1 July 1986.
The Committee notes also with concern that despite considerable efforts made to ensure equality of spouses during marriage and on its dissolution, the husband remains the head of  the household, and is therefore entitled to choose the couple's domicile and to transmit his name and his nationality to the child.
According to article 1 of  the Family Code, marriage as legal cohabitation is founded on the moral and juridical equality of spouses, love, reciprocal respect and understanding, as grounds of  family unity.
Article 2 establishes the principle of  voluntariness in the marriage bond between a man and a woman, equality of spouses in the family, settlement of  family matters on the basis of  mutual consent, and the prohibition of  all forms of  restricting citizens' rights in entering into marriage and in family relations on the basis of  social status, race, nationality, language or religious affiliation.
In the Family Code(article 1) it is determined among general principles that marriage as a legal cohabitation,is based on juridical and moral equality of spouses, in the feeling of  love, respect and mutual understanding as the basis of  unity in a family.
