The Legal and Technical Commission has made much progress during 1997 in its consideration of the draft regulations on prospecting and exploration of polymetallic nodules in the Area, as well as the draft standard terms of exploration contract.
In the case of nodules, these include:regulations for prospecting and exploration of polymetallic nodules, notification of intention to engage in prospecting, application for approval of a plan of work for exploration to obtain a contract, contract for exploration and standard clauses for exploration contracts.
The Council of the Authority, following its approval last year of the plan for exploration by the pioneer investors,began its consideration of the draft regulations on prospecting for and exploration of polymetallic nodules in the international seabed area during its fourth session, held this year.
The contract signed in July 2006 between Germany andthe International Seabed Authority regarding the exploration of polymetallic nodules in an area of the Pacific Ocean represents an important milestone in the Authority's activities, as it refers to the first application for a plan of work since the entry into force of the Convention and the earlier pioneer investor applications.
During the workshop, a presentation was made by a member of the Legal and Technical Commission on document ISBA/7/LTC/1/Rev.1,Recommendations for the guidance of contractors for the assessment of the possible environmental impacts arising from exploration of polymetallic nodules in the Area.
That session was marked by a significant event, namely,the submission of an application for approval of a plan of work for the exploration of polymetallic nodules by the Federal Republic of Germany, as represented by the German Federal Institute for Geosciences and Natural Resources.
In January 2008, the institute submitted a revised training proposal allowing for fourtrainees to take part in a cruise to the contract area of the institute from 14 October to 25 November 2008, to conduct a bathymetric survey for the exploration of polymetallic nodules and the recovery of nodule samples.
At its fortieth session(New Delhi, 2001),AALCO took note of the adoption of the Regulations on Prospecting and Exploration of Polymetallic Nodules in the Area, 2 and the efforts of the Secretary-General of the International Seabed Authority to conclude contracts with the registered pioneer investors.
In evaluating the technical capacity of the applicant, the Commission took note of the scope of responsibilities of the Federal Institute for Geosciences and Natural Resources, as well as information in relation to its marine expertise,particularly in the exploration of polymetallic nodules and polymetallic sulphides.
Work on the deep seabed mining code is also at an advanced stage,while the draft regulation on prospecting and exploration of polymetallic nodules in the“Area”, which includes draft standard terms of the exploration contract, is under consideration by the Legal and Technical Commission.
Recommendations of the workshop to standardize the environmental data and information required by on prospecting and exploration for polymetallic nodules in the area(isba/6/a/18), andrecommendations for the guidance of contractors for the assessment of the possible environmental impact arising from the exploration of polymetallic nodules in the area isba/7/ltc/1.
The Secretary-General noted that,as the Authority had now completed the parts of the mining code relating to prospecting and exploration of polymetallic nodules, polymetallic sulphides and cobalt-rich ferromanganese crusts, the current challenge was to develop regulations on the exploitation of these minerals.
More importantly, AALCC directed the secretariat to consider providing technical assistance tomember States in their representation at the International Seabed Authority and to monitor the progress of work of the Authority on the formulation of the regulations for prospecting and exploration of polymetallic nodules in the international seabed area.
Assisting the Finance Committee, the Legal and Technical Commission, the Council and the Assembly in the adoption of the rules,regulations and procedures for the exploration of polymetallic nodules, and carrying out related administrative work, including preparation of background papers, working papers and draft rules, regulations and procedures;
However, given the delay in signing the contract, there was insufficient time to conduct the selection process to meet that schedule. On 17 January 2008,BGR submitted a revised training proposal allowing for four trainees to take part in a cruise to the contract area of BGR from 14 October to 25 November 2008 to conduct a bathymetric survey for the exploration of polymetallic nodules and the recovery of nodule samples.
