And I take note of  the fact that the Representative on Freedom of  the Media released- while we were here in the Permanent Council- a statement on this very issue stating that the prosecution of journalists in Azerbaijan continues to erode the media freedom environment there.
Recommendations to delete from the Code of  Criminal Procedure provisions on the prosecution of journalists for libel are being examined, taking into account the need for an objective approach to the obligations of  the State to ensure the rights of  all its citizens.
These problems include censorship by Government-controlled media and government agencies, threats of  censorship, banning access for certain political parties, media closures, confiscation, bringing sedition charges, intimidation, attacks,detention and prosecution of journalists, and failure to protect journalists  from attack.
With regard to the prosecution of journalists for defamation, libel or insult, the working group for the improvement of  legislation was studying the possibility of  abolishing the two articles of  the Criminal Code which punished those offences.
However, the media sector has been severely affected by the targeting of journalists  in abductions, killings and acts of  intimidation,by the imprisonment and prosecution of journalists for doing their jobs, by the well-known risks involved in working as a journalist  in a climate of  armed violence and by the restrictions that can be placed on press activities and on freedom of  information.
While pre-publication press censorship involving routine visits by the National Intelligence and Security Service, which was reintroduced for the April elections, was reportedly lifted on 8 August, the Service reportedly distributed to editors a long list of  topics prohibited for publication, including the International Criminal Court,IDPs in Darfur, pro-secessionist rhetoric and the prosecution of journalists.
That the recommendation by Ireland to reform the Penal Code in relation to the prosecution of journalists does not enjoy the support of  the Republic of  Zambia on the basis that there are no provisions in the Penal Code or indeed any other law that are targeted at Journalists. .
Regarding concerns expressed about the prosecution of journalists, the delegation mentioned that there had been two such cases in the last 18 months, and that in one case, the prosecution  was not related to the journalistic work of  the individual, but rather to his extremist activities.
The Special Rapporteur addressed 25 communications, including 8 allegation letters and 17 urgent actions, to the Government to enquire about specific cases and express concern about certain trends,including the arrest and prosecution of journalists, political and student activists, trade unionists, artists, human right defenders, lawyers and women rights activists; the situation of  religious minorities; lack of  access to medical care in prisons, the application of  the death penalty, including the execution of  persons in secret; and the promulgation of  discriminatory legislation.
Lastly, he requested further information on arrests and prosecutions of journalists, in addition to attacks and threats against journalists  by non-State actors or unknown individuals.
Most prosecutions of journalists relate to ordinary offences falling under the Code of  Criminal Procedure.
