Encouraging and calling upon military aggression andflaring up national, racial or religious hatred or intolerance;
(1) Whoever instigates or exacerbates national, racial or religious hatred or intolerance among the peoples and ethnic communities living in Serbia shall be punished by imprisonment of six months to five years.
This law explicitly prohibits transmission anddelivery of messages stirring up ethnic, racial or religious hatred or intolerance.
Pursuant to the Criminal Code, the person causing or inciting national, racial or religious hatred or intolerance among the nationalities and ethnic communities living in Serbia, shall be sentenced to prison from 6 months to 5 years.
These rights can also be limited by article 50 of the Constitution,which prohibits the provocation of national, racial or religious hatred or intolerance.
Pursuant to article 317 of the Criminal Code, the person that instigates or exacerbates national, racial or religious hatred or intolerance among the peoples and ethnic communities living in Serbia, shall be punished by imprisonment of six months to five years.
The Law prescribes that the activity of the citizens' association will be prohibited if such an activity violates human rights and freedoms guaranteed by the Constitution or incite ethnic, racial or religious hatred or intolerance.
The competent prosecutor's offices initiated criminal charges,including for instigating national, racial or religious hatred or intolerance, injury to reputation due to racial, religion, ethnic or other affiliation, and ruining the reputation of a foreign State or international organization.
Governmental control is imposed to the limits provided by article 39 of the Constitution, which introduces some limitations prohibiting incitement to war, violence,national, racial or religious hatred or intolerance.
The work of a political organization shall be banned if it operates for the purpose of: the violent destruction of the constitutional arrangement,if it works on incitement of national, racial or religious hatred or intolerance; if its activities include juvenileor if it abuses them for political purposes, if it joins an international organization or association which acts towards the above objectives.
The Law, in its general provisions, defines internal affairs as affairs related to the protection of freedoms and rights of citizens, guaranteed by the Constitution,as well as to prevention of incitement to ethnic, racial or religious hatred or intolerance.
In this sense, the Act on Telecommunications explicitly prohibits the transfer anddelivery of messages by which national, racial or religious hatred or intolerance are instigated cf. art. 9 of this Act.
In compliance with the Act on Internal Affairs, article 1, subparagraphs 3 and 6, the Ministry of Interior is, among other things, bound to protect human and civil freedoms and rights guaranteed by the Constitution andprevent the spreading of national, racial or religious hatred or intolerance.
It is prohibited to establish an organization which has a program of work and pursues activities aimed at the violent destruction of the constitutional order of the Republic of Macedonia, then at encouraging and calling upon military aggression andflaring up national, racial, or religious hatred or intolerance, or terrorism related activities, and organizations that undertake activities which run contrary to the Constitution or the law or which violate the rights and freedoms of other people.
According to article 23 of this Act, the activity of a citizens' association shall be prohibited should such an activity have been performed so as to violate human freedoms and rights guaranteed by the Constitution or to encourage national, racial or religious hatred or intolerance.
Regarding the incorporation of the provisions of article 4 of the Convention into Montenegrin legislation, after recalling the substance of the criminal provisions set out in paragraphs 38 and 39 of the report(CERD/C/MNE/1), she explained that racial discrimination was expressly prohibited under section 370 of the Criminal Code,paragraph 1 of which provided that incitement to national racial or religious hatred or intolerance among peoples, minoritiesor ethnic groups living in Montenegro was punishable by 6 months' to 5 years' imprisonment.
Programmes and activities of political parties and other associations of citizens may not be directed at the violent destruction of the constitutional order of the Republic, or at encouragement or incitement to military aggression or ethnic, racial or religious hatred or intolerance.
The Ministry of Internal Affairs, the National Security Service and the Procurator's Office are working constantly to prevent, investigate andexpose unlawful acts involving incitement to ethnic, racial or religious hatred or intolerance Table 11.
The programs and the functioning of the associations and the political parties cannot be directed toward violent breaking of the constitutional system of the Republic or towards encouragement of or call for military aggression or stirring up of national, racial or religious hatred or intolerance.
In its general provisions, the Law stipulates that the program, statutes and activities of a political party may not be directed towards violent overthrow of the constitutional order of the Republic of Macedonia, incitement to or calling for military aggression,flaring up of ethnic, racial or religious hatred or intolerance.
Similarly, in accordance with paragraph 3 of article 20 of the Constitution, the programmes and activities of political parties and other associations of citizens may not be directed to violent destruction of the constitutional order of the Republic of Macedonia and to initiating or incitement of military aggression or national, racial or religious hatred or intolerance.
Programmes and actions of citizens' associations and political parties may not be directed to the violent destruction of the constitutional order of the State or to the incitement of war or stimulate national, racial or religious hatred or religious intolerance.
Programs and actions of citizens' associations and political parties may not be directed at the violent destruction of the constitutional order of the state or to the incitement of war or stirring up of national, racial or religious hatred or religious intolerance.
It also stipulated that any call or instigation to national, racial or religious hatred or any form of intolerance was prohibited and punishable.

In that section, articles 38, 42 and50 provide for the possibility of banning certain acts if they incite ethnic, racial or religious hatred and intolerance.
The Law on the Basics of the Public Information System lays down that the programme orientation of public media shall not incite national, racial or religious hatred and intolerance.
The representative stated that the criminal code of Republika Srpska provided sanctions against incitement of national, racial or religious hatred, discord or intolerance.
According to this article, anybody inciting or encouraging national, racial or religious hatred, discord or intolerance or promoting ideas of racial supremacy shall be punished with imprisonment of up to two years.
