Consistent with the Covenant,the Constitution provides for restrictions to be provided by law for the purposes of inter alia, securing due recognition and respect for the rights and freedoms of others.

Acknowledging that the rights and freedoms declared herein shall be subject only to such limitations as are determined by law andare necessary in a democratic society for purposes of securing due recognition for the rights and freedoms of others and[or] for meeting the just requirements of a national emergency threatening the life of the nation,[national security], public order, and public health, and which are consistent with the other rights in the present Declaration.
According to Article 15(7), these provisions are"subject to such restrictions as may be prescribed by law in the interest of national security, public order and the protection of public health ormorality or for the purpose of securing due recognition and respect and freedoms of others, or of meeting the just requirements of the general welfare of a democratic society.
In the exercise of his rights and freedoms,everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.

The Special Rapporteur wishes to emphasize that any restrictions on the rights contained in the Declaration must be in accordance with applicable international obligations anddetermined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society, pursuant to article 17 of the Declaration.

In the absence of an independent judiciary and a secured due process of law for all persons in Iraq, the Special Rapporteur remains concerned about the large number of arbitrary detentions that continue to be made.
