Consequently, there has been a violation of article 25(c) of the Covenant.

The State party should give full effect to all views on individual communications adopted by the Committee, in order to comply with article 2, paragraph 3, of the Covenant which guarantees the right of a  victim of a  human rights violation  to an  effective remedy andreparation when there has been a violation of the Covenant.
Consequently, the Committee should have  found that in this case there has been a violation of article 2, paragraph 2, to the detriment of Alexander Adonis.
If it determines that there has been a violation of the obligations laid down in the Convention, it can order that the injured party should be  guaranteed the enjoyment of his violated right or freedom.
What article 2 intends is  to set forth that whenever a  human right recognized by the Covenant is  affected by the action of a  State agent there  must be a  procedure established by the State allowing the person whose right has been  affected to claim before a  competent body that there has been a violation.
In the Committee's view, therefore, there has been a violation of article 6, paragraph 1, and article 7, read in conjunction with article 2, of the Covenant, with regard to the author's son.
Other courts adopted a  different approach, questioning the male captus, bene judicatus rule, judging the abduction to be  illegal and arguing that abduction and illegal capture cannot be  considered a  legal method of arresting fugitives,even when there has been a violation of international law and the State where the terrorist is  found does not extradite him and does not wish to bring him to trial.
She also maintains that there has been a violation of the right to judicial protection, that is,  the right to a  hearing with due guarantees and presumption of innocence.
The Committee takes into account that the arguments provided by the authors point towards the State party's direct responsibility for Eldiyar Umetaliev's death through an  excessive use of force, and considers that these statements, which the State party has  not contested, and which the authors have  sufficiently substantiated,warrant the finding that there has been a violation of article 6, paragraph 1, of the Covenant, with regard to Eldiyar Umetaliev.
Under these circumstances, the Committee is  of the view that there has been a violation of the author's right, under article 14, paragraph 3(c), to be  tried without undue delay.
In the author's view, there has been a violation of article 14, paragraph 1, not only because she was  not permitted effective access to a  court owing to the proliferation of procedural obstacles, but also because the State Council arbitrarily omitted to consider any of the appeals brought by the complainant and, in particular, her appeals under the Public Health Code, articles 3 and 5 of the European Convention on Human Rights and article 7 of the Covenant.
The Committee accordingly concludes that there has been a violation of article 12, paragraph 2, in respect of the author's wife and three youngest children whom the wife's passport also covered.
If the Court finds that there has been a violation of the Convention or the Protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be  made, the Court shall, if necessary, afford just satisfaction to the injured party.
In the light of the Committee's finding that there has been a violation of article 26 of the Covenant, the Committee considers that it is  not necessary to pronounce itself on a  possible violation  of articles 17 and 23 of the Covenant.
