Right to impart information and ideas; permissible restrictions; right to the equal protection of the law without any discrimination.
The Committee considers that through his articles,the author was exercising his right to impart information and ideas within the meaning of article 19, paragraph 2, of the Covenant.
The human right to impart information and ideas is not limited to statements that are deemed“correct” by authorities.
States are obliged to guarantee a free flow of ideas and information and the right to seek and receive as well as to impart information and ideas over the Internet.

In the Committee's opinion, the above-mentioned actions of the authorities interfere with the author's right to impart information and ideas of all kinds, which is protected under article 19, paragraph 2, of the Covenant.
Article 6 of the Declaration recognizes three different aspects of the right to equality before the law and equal enjoyment of all rights:(a) the right to hold opinions without interference;(b) the right of access to information; and(c)the right to impart information and ideas of all kinds.
The Committee has next to consider whether the restrictions imposed on the author's freedom to impart information and ideas are justified under any of the criteria set out in article 19, paragraph 3, of the Covenant.
The Special Rapporteur had indicated that States were obliged to guarantee a free flow of ideas and information and the right to seek and receive as well as to impart information and ideas over the Internet.
Right to a fair hearing by an independent and impartial tribunal;right to impart information and ideas; right to freedom of association; permissible restrictions; right to take part in the conduct of public affairs; right to the equal protection of the law without any discrimination.
The second paragraph guarantees the right to freedom of expression,which includes not only freedom to impart information and ideas, but also freedom to seekand receive them.
The author further claims a violation of his right to hold opinions under article 19, paragraphs 1 and 2, because of the arbitrary seizure and destruction of 14,000"Five steps to a better life" leaflets,in particular in violation of his right to impart information and ideas of all kinds.
At the same time, Covenant article 19-2 guarantees the right to freedom of expression,including the right to impart information and ideas of all kind, although this right may be limited to protect national security.
The Committee considers that, irrespective of the definition of the author's encounter on 25 March 2008 by the national courts, the above actions by the authorities amount to de facto limitations of the author's rights,in particular of her right to impart information and ideas of all kind, as protected by article 19, paragraph 2, of the Covenant.
It notes that article 19, paragraph 3, allows restrictions on the freedom of expression,including the freedom to impart information and ideas, only to the extent that they are provided by lawand only if they are necessary(a) for respect of the rights and reputation of others; or(b) for the protection of national security or public order(ordre public), or of public health or morals.
The Committee considers that the author, by joining others in issuing a statement supporting the strike and criticizing the Government,was exercising his right to impart information and ideas within the meaning of article 19, paragraph 2, of the Covenant.
It notes that article 19, paragraph 3, allows restrictions on the freedom of expression,including the freedom to impart information and ideas, only to the extent that they are provided by lawand only if they are necessary(a) for respect of the rights and reputation of others; or(b) for the protection of national security or public order(ordre public), or of public health or morals.
In the Committee's opinion, the above actions of the authorities, irrespective of their legal qualification, amount to de facto limitations of the author's rights,in particular the right to impart information and ideas of all kind, under article 19, paragraph 2, of the Covenant.
In this respect, the Special Rapporteur highlights the various aspects of freedom of opinion or expression:while people have the right to impart information and ideas, the public should also have access to media outlets that provide truthfuland accurate reports so that they are able to develop well-informed opinions and obtain information needed to hold public officials to account.
In the opinion of the Committee, the above actions of the authorities interfere with the author's right to freedom of expression and to impart information and ideas of all kind, which is protected under article 19, paragraph 2, of the Covenant.
Disinformation and propaganda, as a rule, are designed and implemented to mislead and interfere with the public's right to know and those rights of individuals to seek and receive,as well as to impart, information and ideas of all kinds, regardless of frontiers, encompassed under the OSCE commitments and other international legal guarantees.
