Where provisions of this Directive can be implemented only by.
Member States may exempt from the provisions of this Directive:.
(26) The provisions of this Directive replace all corresponding provisions of Directive 2000/46/EC.

In the event of a conflict between a provision of Directive 2000/31/EC anda provision of this Directive, the provisions of this Directive shall prevail, unless otherwise provided for in this Directive. .
Where provisions of this Directive can be implemented only by requiring specific technical features, Member States shall inform the Commission according to the procedures provided for by Directive 83/189/EEC(7) which lays down a procedure for the provision of information in the field of technical standards and regulations.
A Member State in which various territorial units have their own rules of law concerning contractual obligationsshall not be bound to apply the provisions of this Directive to conflicts which arise between the laws of those units.
Subject to the provisions set out in paragraphs 2 and 3, the provisions of this Directive relating to the movement of products subject to excise duty under duty-suspension arrangements shall apply.
Member States shall put into force, within eighteen months following notification of this Directive, all amendments to their laws,regulations or administrative provisions required in order to comply with provisions of this Directive and shall forthwith inform the Commission thereof.
In implementing the provisions of this Directive, Member States shall ensure, subject to paragraphs 2 and 3, that no mandatory requirements for specific technical features are imposed on terminal or other electronic communication equipment which could impede the placing of equipment on the market and the free circulation of such equipment in and between Member States.
Those provisions of Directive 2001/77/EC and Directive 2003/30/EC that overlap with the provisions of this Directive should be deleted from the latest possible moment for transposition of this Directive. .
A Member State may provide that, when a rightholder authorizes the initial transmission within its territory of a work or other protected subject matter, he shall be deemed to have agreed not to exercise his cable retransmission rights on an individual basis butto exercise them in accordance with the provisions of this Directive.
The Council, acting unanimously on a proposal from the Commission, may authorise any MemberState to introduce special measures for derogation from the provisions of this Directive, in order to simplify the procedure for collecting VAT or to prevent certain forms of tax evasion or avoidance.
(13) The provisions of this Directive relating to the other obligations of producers and distributors, the obligations and powers of the Member States, the exchanges of information and rapid intervention situations and dissemination of information and confidentiality apply in the case of products covered by specific rules of Community law, if those rules do not already contain such obligations.
Within one year of agreement being reached at international level on the rules for eliminating the double gearing of own funds in financial groups,the Commission shall examine how to bring the provisions of this Directive into line with those international agreements and, if necessary, make appropriate proposals.
Five years after the date referred to in Article 70(2) the Council, acting on a proposal from the Commission,shall examine and if need be revise all those provisions of this Directive which provide for Member State options in the lightof the experience acquired in applying this Directive and in particular of the aims of greater transparency and harmonization of the provisions referred to by this Directive. .
Where the competent authorities of a host Member State ascertain that an investment firm that has a branch within its territory is in breach of the legal orregulatory provisions adopted in that State pursuant to those provisions of this Directive which confer powers on the host Member State's competent authorities, those authorities shall require the investment firm concerned to put an end to its irregular situation.
