Any draft implementing act is submitted to the committee by its chair.
Where no opinion is delivered,the Commission may adopt the draft implementing act.
The basic act provides that the draft implementing act may not be adopted where no opinion is delivered; or.
Without prejudice to Article 7, the Commission shall not adopt the draft implementing act where.
Where the Commission does not adopt the draft implementing act, the chair may submit to the committee an amended version thereof.

Like some interested parties from the upstream anddownstream industry the government also criticised the fact that there was no mention of the immediate termination of measures afterwards in the text of the draft implementing act.

The one exception I just mentioned,where the Commission explicitly needs a positive opinion of the committee before being authorised to adopt the draft implementing act, relates to definitive multilateral trade safeguard measures.
The time given should correspond to the period between the submission of the draft implementing act to the anti-dumping committee established pursuant to Article 15 of Regulation(EC) No 1225/2009 and the anti-subsidy committee established pursuant to Article 25 of Regulation(EC) No 597/2009 and the adoption of that act by the Commission.
