Caseins and caseinates.
(h) caseinates and casein;
The protein content in the case of mixtures containing edible caseinates;
It shall apply to casein and caseinates produced from 15 October 1990.

That sum should be reduced in view of the market price of skimmed-milk powder andthe market price of caseins and caseinates recorded in the last quarter of 2001.
Whereas this situation is such as to hinder the free movement of caseins and caseinates intended for human consumption and to create conditions of unfair competition between users; whereas it therefore has a direct effect on the establishment and functioning of the common market;

To allow food business operators to benefit from a level-playing field on the world market, the present proposal adjusts the compositionalrequirements laid down in the annexes for edible casein and caseinates to those applicable in the above mentioned Codex standard.
The rules concerning the use of casein and caseinates in the manufacture of cheese are intended to counter adverse effects that may result from that aid scheme, taking into account the vulnerability of cheese to substitution operations with casein and caseinates, thereby contributing to stabilise the market.
To take account of these new arrangements, Commission Regulation(EEC) No 2921/90 of 10October 1990 on aid for the production of casein and caseinates from skimmed milk(6), as last amended by Regulation(EC) No 2501/1999(7), must be amended.
Whereas the characteristics of casein and caseinates and those of cheese show similarities such that the latter products are particulary vulnerable to the abovementioned substitution operations; whereas only the use of casein and caseinates in cheese should accordingly be governed by rules at Community level;
Under the conditions determined in accordance with paragraph 2, aid shall be granted for Community-produced skimmed milk processed into casein and caseinates, if such milk and the casein or caseinates produced from it reach certain standards.
Decision to implement other support mechanisms, i.e. payments to skimmedmilk powder used for production of casein and caseinates, payments to skimmed milk powder used for production of feed and export refunds for milk products, is made by the European Commission, based on the price situation on the milk market.
