Important aspects of the revised Convention include.
The revised Convention should be adopted in the very near future.
This Regulation shall not affect the rights existing under the Revised Convention for the navigation of the Rhine Convention of Mannheim.
The revised Convention is focused in particular on guidelines for the composition and issue of identity documents for seafarers.
Laying down the conditions for access to the arrangements under the Revised Convention for the navigation of the Rhine relating to vessels belonging to the Rhine Navigation.
In addition, the Central Commission for Navigation on the Rhine(CCNR) has laid down technical requirements for vessels navigating on the Rhine in the Revised Convention for Rhine Navigation.
An important aspect of the revised Convention is the increased attention paid to transparency and predictability in the chain.
The conditions and technical requirements for this waterway are regularly updated by the Central Commission for Navigation on the Rhine(CCNR)in accordance with Article 22 of the Revised Convention for Rhine Navigation.
Subject to Article 8(2), the Rhine navigation licence, issued in accordance with the revised Convention for the Navigation of the Rhine, shall be valid for all waterways in the Community.
The purpose of the revised Convention is to improve the security of seafarers' identification so that passengers and crew are better protected and the safety of ships increased.
Vessels operating on the Community waterways listed in Article 1 shall carry:- a certificate issued pursuant to Article 22 of the Revised Convention for the Navigation of the Rhine, when operating on a Zone R waterway.
Each Member State may,subject to the requirements of the Revised Convention for the Navigation of the Rhine and after consulting the Commission, adopt technical requirements additional to those in Annex II for vessels operating on Zone 1 and 2 waterways within its territory.
Making a substantial contribution to the revision of the STCW Convention, using Community instruments to secure both the rapid entry into force of the revised convention and its effective implementation and enforcement.
This Regulation shall not affect the rights of third-country operators under the Revised Convention for the Navigation of the Rhine(Mannheim Convention), the Convention on Navigation on the Danube(Belgrade Convention) or the rights arising from the European Community's international obligations.
Whereas Community inland waterways differ as regards safety and should therefore be divided into a number of zones;whereas it is desirable not to conflict with the system set up by the Revised Convention for the Navigation of the Rhine;
Any certificate of qualification,service record book or logbook issued in accordance with the Rhine Navigation Personnel Regulation under the Revised Convention for Rhine Navigation which lay down requirements that are identical to those of this Directive shall be valid on all Union inland waterways.
In addition to negotiating EU comprehensive air transport agreements as the cornerstone of EU external aviation action, the Commission will continue to insist on the swift conclusion of the ratification process of the Eurocontrol revised Convention and the EU Accession Protocol.
Whereas it is desirable to introduce a Community inland navigation certificate,valid on all Community waterways except those where the Revised Convention for the Navigation of the Rhine applies, attesting the compliance of vessels with the common technical requirements;
Following discussions with the third countries signatories to the Revised Convention for the Navigation of the Rhine, and within an appropriate period of time from the conclusion of those discussions, this Regulation as a whole should be amended as necessary in the light of the obligations arising out of the Revised Convention for the Navigation of the Rhine;
Subject to the provisions of Article 3(5),the Rhine navigation licence for boatmasters issued in accordance with the revised Convention for the Navigation of the Rhine shall be valid for all waterways in the Community.
Those amendments shall be made rapidly in order toensure that the technical requirements necessary for the issuing of the Community inland navigation certificate recognised for navigation on the Rhine give a level of safety equivalent to that required for the issuing of the certificate referred to in Article 22 of the Revised Convention for Rhine Navigation.
Within six months of the conclusion of discussions with the third countries signatories to the Revised Convention for the Navigation of the Rhine; the Council, on a proposal from the Commission, shall make any amendments to this Regulation which may prove necessary in the light of the obligations arising out of the Revised Convention for the Navigation of the Rhine.
The second indent of Article 20(1) specifies that“ Those amendments shall be made rapidly in order toensure that the technical requirements necessary for the issuing of the Community inland navigation certificate recognised for navigation on the Rhine give a level of safety equivalent to that required for the issuing of the certificate referred to in Article 22 of the Revised Convention for Rhine Navigation.”.
The document certifying that a vessel belongs to Rhine Navigation, provided for in Council Regulation(EEC)N° 2919/85 of 17 October 1985 laying down the conditions for access to the arrangements under the Revised Convention for the navigation of the Rhine relating to vessels belonging to the Rhine Navigation(1), shall replace the certificate referred to in the first paragraph.
As from the date when the new revising Convention comes into force this Convention shall cease to be open to ratification by the Members.
Should the Conference adopt a new Convention revising this Convention in whole or in part, then, unless the new Convention otherwise provides,(a) the ratification by a Member of the new revising Convention shall ipso jure involve the immediate denunciation of this Convention, notwithstanding the provisions of Article 22 above, if andwhen the new revising Convention shall have come into force;
