Position of ICRC: It is direct and indirect participation in hostilities that must be prohibited.
Various views were expressed with regard to the issue of the distinction between direct and indirect participation of children in armed conflicts.
Distinction between“direct” and“indirect” participation should not be made because it has proved to be difficult to define it in practice.
In practice, it very quickly becomes evident that the subtle distinction between direct and indirect participation poses serious problems.
The distinction between direct and indirect participation in hostilities should be rejected;
It is also UNHCR's view that prohibition of participation  in conflicts should cover both direct and indirect participation.
In many cases, it was almost impossible to distinguish between direct and indirect participation in conflicts and  between voluntaryand  forced recruitment.
UNCHR strongly advocates that the prohibition on participation  should be very broadly construed to prevent both direct and indirect participation in conflicts.
Moreover, the direct and indirect participation in the PSI joint naval exercise by some participants in the six-party talks will create an obstacle to the peaceful solution of the nuclear issue of the Korean peninsula.
The aim of the Secretariat's decisions was to expand direct and indirect participation by States in peacekeeping operations.
Despite the progress that has been made,there continues to be resistance on the issue of voluntary recruitment and  on distinguishing between direct and indirect participation.

UNICEF remained convinced that it was essential to prevent both compulsory and voluntary recruitment into armed forces and  both direct and indirect participation in hostilities for all persons below the age of 18.
Other participants felt that the optional protocol should not qualify the prohibition on participation  of children in hostilities, and that the prohibition on participation  should be very broadly construed to prevent both direct and indirect participation in armed conflicts.
UNICEF has actively publicized its view that it is unacceptable that a clear ban on children's recruitment has not yet been imposed on the direct and indirect participation in hostilities of children below 18 years of age, regardless of whether they have been forced to join armed forces, or whether they appear to have done so voluntarily; this applies equally to governmental and  non-governmental forces.
Through its field experience in war-torn countries,UNICEF has learned that it is very difficult to draw the line between direct  and indirect participation of children in hostilities.
The attention of the working group was drawn to the text of Protocol II Additional to the Geneva Conventions of 1949,which did not distinguish between direct and indirect participation and  which only referred to the prohibition of participation of children in armed conflicts.
She highlighted that raising the minimumage was a goal for the Latin American and  Caribbean countries and  that several normative efforts had been undertaken in order to prevent the direct and indirect participation of children in hostilities.
The present document is an analytical summary of the main points to which ICRC attaches special importance and  which it has endeavoured to address in recent years, namely, minimum age of recruitment, minimum age of participation  in hostilities,the notions of direct and indirect participation, the notions of armed conflictand  hostilities, compulsory recruitment and  voluntary enlistment, and  armed groups.
Part 1 of Article 105.2 of the Tax Code states that for the purposes of the Tax Code, the share of participation  of one enterprise in another enterprise can be calculated in the form of a sum,which is expressed as the percentage of direct and indirect participation of one enterprise in another enterprise.
If the draft optional protocol was to prohibit only certain forms of participation,  this could weaken the broader provisions of Protocol II. In addition,experience in the field has shown that the distinction between direct and indirect participation is often virtually impossible to ascertain.
It would be preferable to support the viewpoint that the prohibited participation  by children in military operations should not be designated as direct participation  since the actual practice in armed conflicts hardly allows any conclusions to be derived from the proposed distinction between direct and indirect participation by children in the conflict.
