Others stated their belief that the final status of Abyei and disputed and claimed border areas are territorial disputes between the Sudan and South Sudan and should be resolved only through negotiated and mutually acceptable solutions between the parties.
They stressed the need for the two countries to spare no efforts towards resolving outstanding issues,including the disputed and claimed border areasand the final status of the Abyei Area.
The Republic of South Sudan is pleased that at least negotiations on the disputed and claimed areas have been convened, though it is disappointed that the African Union High-level Implementation Panel has still not put the two parties in the same room together to actually negotiate.
Despite all that has been achieved, which is not inconsiderable, there nonetheless remain issues that require the urgent attention of this Council:the final resolution of the status of Abyei and the issue of the disputed and claimed border areas between our two countries.
The significant progress in narrowing the gaps between their positions notwithstanding,the parties were unable to settle the disputed and claimed border areas as stipulated in the road map adopted by the Peaceand Security Council and in Security Council resolution 2046 2012.
His letter specified my Government's disappointment withthe terms of reference, stating that:"The experts, as agreed, were supposed to prepare a non-binding opinion on the status of the disputed and claimed areas, not only the five disputed areas.
The focus on the issueof the centreline and delays in the discussions on the disputed and claimed areas and demarcation of the border have raised fears in South Sudan that any determination of the centreline would ultimately define the border between the two countries.
During the ministerial meeting of the Peace and Security Council on 24 October,the Panel suggested that the parties should be allowed two additional weeks to complete their negotiations on how to settle the issues surrounding the disputed and claimed areas, a suggestion that was endorsed by the Council in its communiqué.
For that reason, as long as an agreement to subject the status of the disputed and claimed areas to final and binding international arbitration is not in place in the event that the negotiations hosted by the High-level Implementation Panel fail to resolve all the disputed and claimed areas by 2 August 2012, the uncertainty along the border will likely produce renewed insecurity, which may persist indefinitely.
Urges renewed efforts to determine conclusively the SDBZ centreline on the ground, and reiterates that the centreline of the SDBZ inno way prejudices the current or future legal status of the border, ongoing negotiations on the disputed and claimed areas, and demarcation of the borders;
On that particular matter,I take the opportunity to assure you that the Republic of South Sudan will continue under your auspices to negotiate in good faith to secure a prompt agreement on the disputed and claimed areas, but that it will not accept any extension of the negotiations beyond 2 August 2012, in order to avoid uncertainty and a potential resumption of conflict.
The Security Council welcomes the creation of the AU Border Programme Technical Team(AUBP TT) to determine conclusively the Safe Demilitarized Border Zone(SDBZ) centerline on the ground, and reiterates that the centerline of the SDBZ inno way prejudices the current or future legal status of the border, ongoing negotiations on the disputed and claimed areas, and demarcation of the border.
For this reason, the Republic of South Sudan delegation stands ready to continue to contribute in good faith to assisting the African Union High-level Implementation Panel in securing resolution of the final status of the disputed and claimed areas as mandated, and prior to the 22 September 2012 deadline advanced by the African Union Peace and Security Council.
The Security Council strongly urges the Government of Sudan to accept the AU administrative and security map of November 2011 without further delay in order to enable the full activation of the SDBZ and the JBVMM as required by the Council, and reiterates that the center line of the SDBZ in no way prejudices the current or future legal status of the border,ongoing negotiations on the disputed and claimed areas, and demarcation of the border.
