(b) ensure protection of professional secrecy equivalent to that laid down in this Regulation;
The Commission shall adopt delegated acts in accordance with Article 301a specifying the criteria for assessing whether the solvency regime of a third country that applies to reinsurance activities of undertakings with their head office in that third country is equivalent to that laid down in Title I.
The term of protection of the resale right shall correspond to that laid down in Article 1 of Directive 93/98/EEC.
The Commission may adopt delegated acts in accordance with Article 301a specifying the criteria for assessing whether the prudential regime in a third country for the supervision of groups is equivalent to that laid down in this Title.
I particularly emphasise the written translation of documents essential to the proceedings andthe guarantee that the level of protection should never be inferior to that laid down in the European Convention on Human Rights and Fundamental Freedoms and the Charter of Fundamental Rights of the European Union.
The Commission may adopt delegated acts, in accordance with Article 301a and subject to the conditions of Articles 301b and 301c,specifying the criteria to assess whether the prudential regime in a third country for the supervision of groups is equivalent to that laid down in this Title.
However, it must be pointed out, first, that the 30-year period corresponds exactly to that laid down in Article 1 of Regulation No 354/83, the expiry of which enables, in principle, anyone who has so requested to gain access to the historical archives of the Community institutions.
(b) the recipient Contracting Party shall ensure, in the use of communicated data, a level of protection at least equal to that laid down in its national law for the use of similar data;
Where in accordance with paragraph 2 the solvency regime of a third country has been deemed to be equivalent to that laid down in this Directive, reinsurance contracts concluded with undertakings having their head office in that third country shall be treated in the same manner as reinsurance contracts concluded with undertakings authorised in accordance with this Directive.
Whereas the derogations were granted until 31 December 1996 andsubject to a review mechanism similar to that laid down in Article 28l of Directive 77/388/EEC(3);
Where in accordance with paragraph 2 the solvency regime of a third country has been deemed to be equivalent to that laid down in this Directive, reinsurance contracts concluded with undertakings having their head office in that third country shall be treated in the same manner as reinsurance contracts concluded with undertakings authorised in accordance with this Directive.
The Commission may adopt implementing measures specifying the criteria to assess whether the solvency regime in a third country is equivalent to that laid down in Title I, Chapter VI.
It must be recalled that the prohibition of inhuman ordegrading treatment laid down in Article 4 of the Charter corresponds to that laid down in Article 3 of the ECHR and that, to that extent, its meaning and scope are, in accordance with Article 52(3) of the Charter, the same as those conferred on it by that convention.
A delegated act has been adopted in accordance with paragraph 4 to the effect that the supervisory regime of that third country has been deemed to be equivalent to that laid down in Title I, Chapter VI.
Without prejudice to Article 8, from 1 January 1997 to 30 June 2000, andsubject to a review mechanism similar to that laid down in Article 28l of Directive 77/388/EEC, Sweden shall be authorized to continue to apply the same restrictions as it applied on 31 December 1996 on the quantity of alcoholic drinks and tobacco products which may be brought into Swedish territory without further excise duty payment by private individuals for their own use.
European statistics based on the data referred to in Article 4 shall be disseminated with a frequency similar to that laid down for the transmission of data by the Member States.
The Commission may, in accordance with the regulatory procedure referred to in Article 301(2) and taking into account the criteria adopted in accordance with paragraph 1,decide whether the solvency regime of a third country applied to reinsurance activities of undertakings with their head office in that third country is equivalent to that laid down in Title I.
(i) such other collective investment undertakings are authorised under laws which provide that they are subject to supervision considered by the Bank to be equivalent to that laid down in Community law, and that cooperation between authorities is sufficiently ensured.
As regards the intervention of the HFSF in the Bank's management, the HFSF noted that it would respect the Bank's autonomy andnot interfere with its day-to-day management given that its role is limited to that laid down in the HFSF Law.

In carrying out joint inspections together with the EDPS, members and staff of national supervisory authorities shall, taking due account of the principles of subsidiarity and proportionality, have powers equivalent to those laid down in Article 43(4) andbe bound by an obligation equivalent to that laid down in Article 43(6).
Such other collective investment undertakings are authorised under laws which provide that they are subject to supervision considered by the competent authorities of the UCITS home Member State to be equivalent to that laid down in Community law, and that cooperation between authorities is sufficiently ensured;

The limited period referred to in paragraph 5 shall end on 31 December 2020 or on the date on which, in accordance with paragraph 3,the prudential regime of that third country has been deemed to be equivalent to that laid down in this Title, whichever is the earlier.
If the criteria adopted in accordance with paragraph 3 have been fulfilled by a third country, the Commission may, in accordance with Article 301a, and assisted by EIOPA in accordance with Article 33(2) of Regulation(EU) No 1094/2010,adopt delegated acts determining that the supervisory regime of that third country is equivalent to that laid down in Title I, Chapter VI.

The limited period referred to in the first subparagraph of paragraph 4 shall end on 31 December 2020 or on the date on which, in accordance with paragraph 2,the supervisory regime of that third country has been deemed to be equivalent to that laid down in Title I, whichever is the earlier.
If the criteria adopted in accordance with paragraph 2 of this Article have been fulfilled by a third country, the Commission may, in accordance with Article 301a, and assisted by EIOPA in accordance with Article 33(2) of Regulation(EU) No 1094/2010,adopt delegated acts determining that the prudential regime of that third country is equivalent to that laid down in this Title.
