Rights related to automatic processing.
Council of Europe Convention No. 108 dated 28 January 1981 for the Protection of Individuals with Regard to Automatic Processing of Personal Data.
The law shall determine what is personal data as well as the conditions applicable to automatic processing, connection, transmission and use thereof, and shall guarantee its protection by means of an independent administrative body.

The information submitted will be protected, in conformity with the Council of Europe Convention of 28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data and taking account of Recommendation No R(87)15 of 15 September 1987 of the Council of Europe Regulating the Use of Personal Data in the Police Sector, by at least the same rules of confidentiality and protection of personal data as those that apply under the national legislation applicable to the requesting FIU.
Today we mark the 30th anniversary of the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data“Convention 108”.
The data protection provisions are based mainly on the principles of the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data of 28 January 1981 and of Recommendation No R(87) 15 of the Committee of Ministers of the Council of Europe of 17 September 1987.
The Ministers reaffirmed the link between finalization of such a computerized system andthe draw-ing-up of an agreement concerning the protection of individuals with regard to automatic processing of personal data.
These rules will build upon the minimum data protection principles set by the Convention of 28 January 1981 for the protection of individuals with regard to automatic processing of personal data and its Additional Protocol of 8 November 2001, and take account of Recommendation(87)15 regulating the use of personal data in the police sector, both adopted in the framework of the Council of Europe.
All of the Community Member States are signatories to the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Per sonal Data.
The contracting parties take note that a law on the protection of personal data subject to automatic processing was published by the Portuguese Republic on 29 April 1991.
The owner of the website will provide users of permanent access to the present document so that, prior to the delivery of personal data,they can give their consent to the owner of the website applicable to automatic processing of personal data.
Personal data shall be exchanged in accordance with the domestic and international rules applicable,taking account of the principles of Convention No 108 of the Council of Europe of 28 January 1981 for the protection of individuals with regard to automatic processing of personal data and- as appropriate- Recommendation No R(87)15 of the Committee of Ministers of the Council of Europe of 17 September 1987 regulating the use of personal data in the police sector.
That can only be exchanged with countries who have concluded an operational agreement with Europol, and, before such an agreement can be concluded, Ukraine needs to adopt a law on personal data protection andto ratify the 1981 Council of Europe Convention on the Protection of Individuals with regard to Automatic Processing of Personal Data and its Protocol.
Furthermore, attention has to be paid to Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms andto the Council of Europe Convention No. 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data of 1981,to its Additional Protocol of 2001 regarding supervisory authorities and transborder data flows and to the Recommendation No. R(87) 15 of 1987 regulating the use of personal data in the police sector.
A recommendation for a Council Decision on the accession of the European Community to the Council of Europe Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data(idem);
Accordingly, the necessary steps should be taken to guarantee a level of data protection which corresponds at least to that which results from the application of the principles of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(Council of Europe) signed in Strasbourg on 28 January 1981, together with subsequent amendments thereto, in particular the Protocol opened for signature on 8 November 2001, once such amendments are in force between the Member States.

We emphasize the importance of ensuring that any exchange of information is in conformity with the relevant rules relating to data protection,especially with the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data of 28 January 1981.
Whereas Convention 108 of the Council of Europe for the Protection of Individuals with regard to Automatic Processing of Personal Date(1981) should be taken into account;
Personal data shall be stored and used pursuant to the obligations undertaken by the Parties under the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data ETS No. 108.
In relation to data protection,the 1981 Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data has been ratified by all the Member States of the Union.

Any reference to the Council of Europe Convention of 28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal data should be read as reference to this Framework Decision.
Other information, in particular the data listed in the first sentence of Article 6 of the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data of 28 January 1981, shall not be authorised.
With effect from August 1987,the United Kingdom's ratification of the Council of Europe Convention on the Protection of Individuals with regard to automatic processing of personal data(Convention No 108) was extended to the Bailiwick of Guernsey.
Any reference to the Convention No 108 of the Council of Europe of 28 January 1981 for the protection of individuals with regard to automatic processing of personal data shall be construed as a reference to this Framework Decision.
Decision authorising Member States to approve the adoption by the Committee of Ministers of the Council of Europe of the amendment to Convention No 108 on the protection of individuals with regard to automatic processing of personal data, enabling the European Communities to accede to the Convention, adopted by the Council on 8 June.
