In order to justify the exemption, the joint exploitation should relate to products or processes for which the use of the results of the research and development is decisive, and each of the parties is given the opportunity of exploiting any results that interest it.
The purpose of the agreement is to promote research and development(R& D) of certain space electronic equipment in the field of civil radio communications and broadcasting satellites and data transmission to, from and between satellites and/or space vehicles throughout the world,as well as to promote joint exploitation of the results and a degree of joint marketing.
The Commission has accepted the principle of joint exploitation over a limited period of the results of research and development(see the ninth recital in the preamble) to Regulation(EEC) No 418/85.

It may, for example, be responsible for the sale of certain products for its members;organize the pooling and joint exploitation of partial licences, coordinate the production and delivery schedules of members, develop their marketing, bid for and be awarded public works and public supplied contracts, carry out joint research work and jointly supply services such as transport, purchasing and distribution.
