Council Regulation(EC)N° 1288/2009 was adopted on 27/11/2009 and established transitional technical measures from 01/01/2010 to 30/06/2011.
Transitional technical measures from 1 January 2010 to 30 June 2011 concerning the conservation of fish stocks.
The purpose of this proposal is to extend existing transitional technical measures until the end of 2012.

This report, which we will be adopting tomorrow, allows for the transitional technical measures governing the fisheries sector to be extended.
This regulation on transitional technical measures resulted from the lack of agreement in 2008 on the draft regulation aimed at simplifying and clarifying Community rules on the conservation of fisheries resources.

Bottom-set gillnets are currently restricted in entering deep-sea fisheries by Council Regulation(EC) No 1288/2009 establishing transitional technical measures from 1 January 2010 to 30 June 201113.

With regard to the report on transitional technical measures, I would like to highlight- which was also done during a number of speeches- the amendment supported by myself and two other Members, seeking to eliminate negative discrimination with no scientific basis, and I emphasise that there is no scientific basis justifying the negative discrimination against some segments of the Portuguese small-scale fleet that use trammel nets.
As Regulation(EC) 850/98 is still in force, certain technical measures will continue to apply while the Council didreach political agreement on transitional technical measures for 2010, extending for 18 months the transitional technical measures contained in Annex III to the 2009 TACs and Quotas Regulation 16360/09.
Council Regulation(EC) No 1288/2009 of 27 November 2009 establishing transitional technical measures from 1 January 2010 to 30 June 20117 provides for the continuation of temporary technical measures previously catered for in Annex III to Regulation(EC) No 43/2009, thereby allowing those measures to continue to apply until the time of adoption of permanent measures on the basis of the Commission proposal of 4 June 2008 for a new Regulation concerning the conservation of fisheries resources through technical measures8.
Such proposal was intended to replace Council Regulation(EC) No 850/98 for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms2 andcertain transitional technical measures as laid down in Annex III to Council Regulation(EC) No 43/20093 establishing for 2009 the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks.
The proposal to extend thevalidity of the 2009 Council Regulation on establishing transitional technical measures by 18 months, which means until 31 December 2012, will enable the Commission to prepare a new package of technical measures which will become part of the reform of the common fisheries policy.
For reasons of legal certainty and to maintain the proper conservation and management of marine resources, Council Regulation(EC)No 1288/2009 establishing transitional technical measures from 1 January 2010 to 30 June 20114 was adopted, providing for the continuation of temporary technical measures catered for in Annex III to Regulation(EC) No 43/2009 for a transitional period of 18 months.
For this reason, for reasons of legal certainty and to maintain the proper conservation and management of marine resources, Council Regulation(EC)No 1288/2009 establishing transitional technical measures from 1 January 2010 to 30 June 20114 was adopted, providing for the continuation of temporary technical measures catered for in Annex III to Regulation(EC) No 43/2009 for a transitional period of 18 months.
At present, the EU is considering transitional measures and technical adaptations related to environmental legislation that has been adopted recently, since the close of negotiations.
