The master or his authorised representative of a Community fishing vessel to which catch has been transhipped shall, immediately after landing Dissostichus spp.,obtain on the catch document received from the transhipping vessels.
Member States shall communicate a copy of all validated catch documents or re-export certificates, except in cases where Article 4(3) applies, as soon as possible and in any case within five working days following the date of validation, or without delay where the expected duration of the transportation should not take more than five working days, to the following.
Any such landing, transfer, delivery, harvest, domestic trade, import, export orre-export of bluefin tuna without a completed and validated catch document or a re-export certificate shall be prohibited.
Member States shall take all necessary measures to ensure that whenever Dissostichus spp. is landed or transhipped,their flag vessels authorised to engage in harvesting Dissostichus spp. have duly completed a catch document.
Where a Member State, as a result of examination or verifications pursuant to paragraph 1 andin cooperation with the validating authorities concerned, determines that a catch document or re-export certificate is invalid, the domestic trade, import, export or re-export of the bluefin tuna concerned shall be prohibited.
Member States shall notify the Commission, which shall inform the CCAMLR Secretariat, of the name of the national authority or authorities(giving names, addresses, and telephone and fax numbers and e-mail addresses)responsible for issuing and validating catch documents.
Member States shall take all necessary measures to ensure that each shipment of Dissostichus spp. imported into their territory is accompanied by the export-validated or re-export-validated catch document or documents corresponding to the total amount of Dissostichus spp. contained in the shipment.
The said master or his authorised representative shall immediately sign and convey by the most rapid electronic means available a copy or, if the catch landed was divided,copies of the signed catch documents to the Flag Member State of the vessel.
If, as a result of examinations or verifications carried out pursuant to paragraphs 1 and 2,a doubt arises regarding the information contained in a catch document, Member States shall cooperate with the competent authorities who validated the catch document(s) or re-export certificate(s) to resolve such doubts.
The said master or his authorised representative shall immediately sign and convey by the most rapid electronic means available a copy or, if the catch landed was divided,copies of the signed and stamped catch document to the Flag States that issued those catch documents. .
Member States shall immediately transmit to the Secretariat by the most rapid electronic means, and with a copy to the Commission,a copy of the export validated or re-export-validated catch documents so that they may be made available next working day to all Contracting Parties.
Each Member State shall verify, including by using inspection reports, observer reports and VMS data, the submission of logbooks and relevant information recorded in the logbooks of its fishing vessels in the transfer or transhipment documents andin the Bluefin tuna catch documents in accordance with Article 109 of Regulation(EC) No 1224/2009.
Member States shall ensure that their customs authorities or other competent official agents request and examine the import documentation of each shipment of Dissostichus spp. imported into their territory in order toverify that it includes the export-validated or re-export-validated catch document or documents corresponding to the total amount of Dissostichus spp. contained in the shipment.
