EXPORT AUTHORISATION.
Criteria for granting export authorisations.
(31) The export authorisation system should not go beyond what is proportionate.
An application for an export authorisation shall record.
However, for export authorisation applications made before the date of entry into force of this Regulation, the relevant provisions of Regulation(EC) No 3381/94 shall continue to apply.
(b) guidance concerning export authorisation forms.
In order for export authorisations to be denied, an EU country's authorities must have good reason to believe that the goods could be used for the purposes of torture or other cruel or unusual punishment.
Without prejudice to any possible implementation of enforcement measures, the export authorisation referred to in paragraph 1 shall be refused if.
In such cases the export authorisation shall be annotated accordingly at the time of issue.
When completing the formalities for the export of dual-use items at the customs office responsible for handling the export declaration,the exporter shall furnish proof that any necessary export authorisation has been obtained.
There are 4 types of export authorisations, as indicated below.
At the request of exporters, global export authorisations that contain quantitative limitations shall be split.
Where a Member State considers that there exists in its territory a situation such as that defined as regards the Community in Article 6(1), it may, as an interim protective measure,make the export of a product subject to the production of an export authorisation, the granting of which shall be governed by such provisions and subject to such limits as that Member State shall lay down.
Provisions governing the export authorisation of halon as a controlled substance are set out in paragraph 4.
(34) If a country has not abolished capital punishment for all crimes and confirmed that abolition through an international commitment,the competent authorities should, when examining a request for an export authorisation, check whether there is a risk that the end-user in the country of destination would use the exported goods for such punishment.
Provisions governing the export authorisation of halon as a controlled substance are set out in paragraph 4.
If multiple shipments between the same exporter and end-user take place, the competent authorities should be allowed to review the status of the end-user on a periodic basis,for example every six months, rather than every time an export authorisation for a shipment is granted, without prejudice to the right of the competent authorities to annul, suspend, modify or revoke an export authorisation where warranted.
All individual and global export authorisations shall be issued on forms consistent with the model set out in Annex IIIa.
(3) Regulation(EEC) No 3769/92 must be amended to take account of the changes of Regulation(EEC)No 3677/90 separating the provisions on export authorisation from those on pre-export notification for the scheduled substances listed in Category 1 of the Annex.
(14) This Regulation lays down an export authorisation system designed to prevent certain goods from being used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment.
If an export might prejudice its essential security interests,a Member State may request another Member State not to grant an export authorisation or, if such authorisation has been granted, request its annulment, suspension, modification or revocation.
Before any Member State grants an export authorisation which has been denied by another Member State or States for an essentially identical transaction within the previous three years, it will first consult the Member State or States which issued the denial(s).
The competent authorities, acting in accordance with this Regulation,may refuse to grant an export authorisation and may annul, suspend, modify or revoke an export authorisation which they have already granted.
The Council adopted a regulation laying down rules on export authorisation for firearms for the purpose of implementing article 10 of the United Nations protocol against the illicit manufacturing of and trafficking in firearms(41/11 and 6833/12 ADD 1 REV 1).
The Commission shall forward a copy of each export authorisation to the competent authority of the Member State concerned.

While security industry firms in coastal countries have unproblematic access to sea transport for their products,provided that they comply with licence requirements and obtain export authorisations for their products, manufacturers in Member States without direct access to the sea need to go through a further process of obtaining licences and transit authorisations for the transport of their products through the territory of the relevant Member State to seaports in that Member State.
Regulation(EC) No 428/2009 introduces Union General Export Authorisations as one of the four types of export authorisations available under that Regulation.
Such removal of a destination from the scope of a Union General Export Authorisation should not preclude an exporter from applying for another type of export authorisation under the relevant provisions of Regulation(EC) No 428/2009.
