INTERPRETATIVE NOTES.
(‘the implementing regulation') contains an Annex 23 entitled‘Interpretative Notes on Customs Value'.
To that end, Article XI of GATT 1994 and the interpretative notes thereon are incorporated into this Agreement and made an integral part thereof.
Each Party shall accord national treatment to the goods of the other Party in accordance with Article III of GATT 1994,including its interpretative notes.
Wherever possible, other solutions, such as interpretative notes or administrative measures, should be used.
In accordance with Point 2 of the Interpretative Notes on Customs Value in Annex 23 to the implementing regulation, concerning Article 31(1) of the Community Customs Code, the methods of valuation to be used under Article 31(1) should be those laid down in Articles 29 and 30(2) of the Code but a‘reasonable flexibility' in the application of those methods would be in conformity with the objectives and provisions of Article 31(1) of the Code.
Other tools: Almost all Commission departments issue guidelines, handbooks or interpretative notes to make the transposition process smoother.
Each Party shall ensure,in accordance with Article VIII of GATT 1994 and its interpretative notes, that all fees and charges of whatever nature other than customs duties or other measures referred to in Article 27 of this Agreement, imposed on, or in connection with, the import or export of goods are limited in amount to the approximate cost of services rendered and do not represent an indirect protection of domestic goods or taxation of imports or exports for fiscal purposes.
Nothing in this Agreement shall be construed in such a way as to prevent the adoption or enforcement by any Party of measures in accordance with Articles XX andXXI of GATT 1994 and its interpretative notes, which are hereby incorporated into and made an integral part of this Agreement.

Nothing in this Chapter shall be construed to prevent the adoption or enforcement by any Party of measures in accordance with Articles XX and XXI of GATT 1994 andany relevant interpretative notes to those Articles under GATT 1994, which are hereby incorporated into this Agreement and made an integral part thereof.
To this end, Article III of GATT 1994 and its interpretative notes are incorporated into and made part of this Agreement, mutatis mutandis.
Having regard to the need to establish a customs value for the purpose of applying a variable antidumping duty andto the‘reasonable flexibility' mentioned in Point 2 of the Interpretative Notes, it must be accepted that the price indicated in a sale which took place prior to that on the basis of which the customs declaration was made may constitute data available in the Community which Article 31(1) of the Community Customs Code allows to be used as a basis for determining customs value.
According to its revised interpretative note, which was adopted on 10 June 2005, SR VII should be transposed by December 2006.

In addition, the inclusion of financing of travelling abroad for terrorism(an offence not previously contained in the Framework Decision 2002/475/JHA) implements Article 5 of the Additional Protocol as well as Recommendation No 5 of FATF(as thiswas clarified by the recently adopted amendment to the Interpretative Note to Recommendation No 5).
Furthermore, the FATF itself was originally behind the splitting of these two concepts: the title of the nine SRs referred to in point 2.3 is simplyTerrorist financing; the title of the Interpretative Note to the SRs is Special recommendations on terrorist financing, but the text mentions"preventing terrorists and other criminals from having unfettered access…".
The Commission will publish summary notes of the transposition workshops and additional interpretative guidance when needed.
