In order to ensure the opposability of such limitations to third parties, the United Nations concludes agreements with Member States in whose territories peacekeeping missions are deployed, andincludes in such agreements provisions for the application of such financial and temporal limitations on third-party liability.

In its report dated 14 October 1996(A/51/491), the Advisory Committee on Administrative andBudgetary Questions concurred in the view of the Secretary-General with regard to financial and temporal limitations, subject to further study of their ceiling, duration and the modalities of their establishment para. 10.

In the laws of most States which provide for temporal limitations for the submission of tort claims, the period of limitation runs from the time when the action or the event causing the injury or loss occurred, or, if the claimant did not know and could not have reasonably known of the injury or loss or of the identity of the party who inflicted it, from the time the claimant became aware of them.
In paragraph 47 of the present report, the General Assembly is requested to endorse the modalities of establishing the financial and temporal limitations in legally binding instruments proposed in section IV and to adopt a resolution stipulating the temporal and financial limitations of the Organization.
Some such exemptions are spelled out in:the law on foreigners, which applies to taking up residence, temporal limitations on sojourn, and admissibility of expulsion; the law on purchase of immovables(realty) of 24 March 1920, which requires foreigners to obtain a licence from the Minister of the Interior; and in the law on combating unemployment of 14 December 1994, which requires the consent of the head of the provincial labour exchange to the employment of a foreigner.
The present report analyses the provisions of article 51 of the model status-of-forces agreement,elaborates criteria and guidelines for implementing the principles of financial and temporal limitations on the liability of the United Nations and proposes modalities for establishing these limitations in a legally binding instrument.
The Advisory Committee concurs in the view of the Secretary-General with regard to the financial and temporal limitations, although such aspects of the limitations as the ceiling of compensation, modalities of establishing the financial limitation of the Organization and duration of the limitation period must be further studied.
Mr. Mselle(Chairman of the Advisory Committee on Administrative and Budgetary Questions), referring to the report of the Secretary-General on third-party claims(A/51/903),said that the Advisory Committee recommended that the General Assembly endorse the modalities for establishing the financial and temporal limitations in legally binding instruments proposed in paragraphs 37 to 41 of the report and consider the adoption of a resolution stipulating those limitations. .
In paragraph 54 of the present report, the General Assembly is requested to endorse the proposals andrecommendations contained in section IV concerning financial and temporal limitations, counter-claims, set-offs and recovery from the States contributing contingents in specific cases of gross negligence, wilful misconduct or international criminal liability of the member of the Forces.

A temporal limitation is a form of limitation on the liability of the Organization, in that claims submitted after the limitation period would no longer be regarded as valid.
By its resolution(A/RES/58/153, para. 9)adopted at its 58th session, the General Assembly removed the temporal limitation on the duration of the Office.
Another point worth mentioning was whether the temporal limitation applicable to reservations was justified with respect to interpretative declarations.
He notes that article 14 contains no express temporal limitation which would prevent the Committee from examining petitions on the basis of facts that had taken place prior to the date of deposit of the declaration.
A temporal limitation on the submission of claims against the Organization is designed to ensure that third-party claims are submitted within a reasonable period of time and before witnesses and evidence disappear and memories fade.
At the same time, any temporal limitation must be of a reasonable duration so as not to unduly deprive claimants of their right to seek compensation in the event they suffer injury or loss in situations which entail the liability of the Organization.
