EUROPEAN ARREST WARRANT AND SURRENDER PROCEDURES BETWEEN MEMBER STATES.
Second evaluation report on the state of transposition of the Framework Decision on the European arrest warrant and the surrender procedures between Member States.
Article 31 of FrameworkDecision 2002/584 on the European arrest warrant and the surrender procedures between Member States must be interpreted as referring only to the situation in which the European arrest warrant system is applicable, which is not the case where.
The Framework Decision on the European arrest warrant aims to simplify and accelerate surrender procedures for persons between Member States.
The purpose of the Framework Decision on the European arrest warrant and the surrender procedures between Member States is to introduce a simplified system for the surrender, as between judicial authorities, of convicted persons or suspects for the purpose of enforcing judgments or conducting criminal proceedings.
In September 2001, the Commission presented a proposal for a Council framework decision on the European arrest warrant and surrender procedures between Member States.98.
The Council Declaration annexed to theFramework Decision on the European arrest warrant and the surrender procedures between Member States,34 adopted on 13 June 2002, calls for further harmonisation in relation to the offences listed in Article 2(2) of the Framework Decision,35 where there has been no approximation in the Union as yet.
The principle was implemented by Articles 4(6) and 5(3)of the Framework Decision on the European arrest warrant and surrender procedures between Member States.

The Council recommended that an early practical evaluation of the application of the European arrest warrant andcorresponding surrender procedures between Member States be conducted e.g. on the basis of statistical data.
In order to improve the functioning of judicial cooperation in the European Union, the rights provided for in this Directive should also apply, mutatis mutandis, to proceedings for the execution of a European Arrest Warrant according to the Council Framework Decision 2002/584/JHA of 13June 2002 on the European Arrest Warrant and the surrender procedures between Member States36;
On a practical level, the Presidency hopes to reach an agreement in Laeken on the following issues:a framework decision on the European arrest warrant and the surrender procedures between Member States; a framework decision on the fight against terrorism; a framework decision on the execution of orders freezing assets or evidence in the European Union and an agreement on the common list of terrorist organisations.
