Interpretative documents.
(a) a list of the relevant interpretative documents referred to in Article 3(3);
The resulting standards shall be expressed as far as practicable in product performance terms, having regard to the interpretative documents.

Whereas it is therefore necessary to draw up interpretative documents in order to establish links between mandates for standards and the essential requirements;

European technical approval for a product shall be based on examinations,tests and an assessment on the basis of the interpretative documents referred to in Article 3(3) and of the guidelines referred to in Article 11 for this product or the corresponding family of products.
(1) Article 3(2) and(3) of Directive 89/106/EEC state that in order to take account of different levels of protection for the construction works that may prevail at national, regional or local levels,each essential requirement may give rise to the establishment of classes in the interpretative documents.

Directive 89/106/EEC envisages that in order to take account of the different levels of protection for construction works at national, regional or local level,it may be necessary to establish in interpretative documents classes corresponding to the performance of products in respect of each essential requirement.
In addition, the fact that there is provision for subsequent drafting of interpretative documents to deal with other problems in connection with the poor operation of national review procedures as a result of incorrect interpretation of existing provisions by some Member States indicates the proportionate nature of the Commission's initiative.
Whereas, as a basis for the harmonized standards or other technical specifications at European leveland for the drawing up or granting of European technical approval, interpretative documents will be established in order to give concrete form to the essential requirements at a technical level;
The essential requirementsshall be given concrete form in documents( interpretative documents) for the creation of the necessary links between the essential requirements laid down in paragraph 1 and the standardization mandates, mandates for guidelines for European technical approval or the recognition of other technical specifications within the meaning of Articles 4 and 5.
(1) Directive 89/106/EEC envisages that in order to take account of the different levels of protection for construction works at national, regional or local level,it may be necessary to establish in the interpretative documents classes corresponding to the performance of products in respect of each essential requirement.
(3) The Communication of the Commission with regard to the interpretative documents of Directive 89/106/EEC(3) lists, in paragraph 2.2 of the interpretative document No 2, a number of interrelated measures for the satisfaction of the Essential Requirement"Safety in case of fire" that together contribute to defining the fire safety strategy that can be developed in different ways in Member States.
Where guidelines referred to in Article 11 do not or not yet exist, European technical approval may beissued by reference to the relevant essential requirements and the interpretative documents where the assessment of the product is adopted by the approval bodies acting jointly in the organization referred to in Annex II.
If the relevant European technical specifications, either themselves or on the basis of the interpretative documents referred to in Article 3(3), distinguish between different classes corresponding to different performance levels, Member States may determine the performance levels also to be observed in their territory only within the classifications adopted at Community level and only subject to the use of all or some classes or one class.
Whereas point 4.2.1 of Interpretative Document No 2'Safety in case of fire',contained in the Communication of the Commission with regard to the interpretative documents of Council Directive 89/106/EEC(4), justifies the need for different levels of the Essential Requirement as a function of the type, use and location of the construction work, its layout, and the availability of the emergency facilities;
Whereas point 4.3.1.1 of interpretative document No 2 attached to the Commission communication with regard to the interpretative documents of Council Directive 89/106/EEC(3) specifies that to enable the reaction-to-fire performance of products to be evaluated on a common basis, a harmonised solution will be developed which may utilise full or bench scale tests that are correlated to relevant real fire scenarios;
Whereas the special nature of construction products requires the precise formulation of these harmonized standards;whereas it is therefore necessary to draw up interpretative documents in order to establish links between mandates for standards and the essential requirements; whereas harmonized standards, expressed as far as possible in terms. of product performance, take account of these interpretative documents, which shall be drawn up in cooperation with the Member States;
(4) Paragraph 4.3.1.2.2 of interpretative document No 2 identifies the requirements for construction products for roofs exposed to an external fire.
Further analysis needs to be undertaken on the measures discussed in the present Communication,in particular the legislative instrument on concessions and the interpretative document on IPPPs.
(8) The harmonised solution lies in asystem of classes that are not included in the interpretative document.
Whereas this solution lies in asystem of classes which are not included in the interpretative document but which were adopted in Decision 94/611/EC;
(2) With respect to the essential requirement of safety in the event of fire, interpretative document No 2 lists a number of interrelated measures which together define the fire safety strategy to be variously developed in the Member States.
(3) Interpretative document No 2 identifies one of those measures as the limitation of the generation and spread of fire and smoke within a given area by limiting the potential of construction products to contribute to the full development of a fire.
