This Impact Assessment accompanies the proposal for the recast of the 92/75/EEC“Energy Labelling Directive for Household Appliances”1(hereafter ELD).
The Energy Labelling Directive has a crucial role to play in the achievement of the EU energy efficiency target of 20% by 2020.
This will provide a basis upon which to assessthe need for additional initiatives for products covered, in particular, by the Ecodesign and the Labelling Directive or the Ecolabel Regulation.
The revision of the energy efficiency labelling directive is a first step to help consumers in making informed choices to reduce their energy bills.
In November 2008, the Commission adopted a Communication on energyefficiency71 together with proposals for revising the Energy Labelling Directive and for recasting the Energy Performance of Buildings Directive. .
The Energy Labelling Directive will at this stage be extended to cover a wider range of products, including energy-using and other energy-related products.
Information to consumers under EU policy has focused on energyefficiency for household appliances and office equipment under the Energy Labelling Directive and Energy Star Programme, or has covered only a limited number of products(under the Ecolabel).
The Energy Labelling Directive will be revised to be applied to additional energy-using and energy-related products, and not to household appliances alone.
In order to overcome this fragmentation and to further theuptake of energy and environmentally performing products, the Labelling Directive, following an impact assessment, will establish a harmonised base for public procurement and incentives provided by the EU and its Member States, as explained below.
The Energy Labelling Directive encourages consumers to buy more energy efficient products by informing them about the energy use of products through an energy label. .
In a public deliberation, the Council took note of a progress report( 8989/09) summarising the work done so far on the energy efficiency package, which contains the following three proposals:an energy labelling directive( 15906/1/08), a tyres labelling directive( 15920/08) and an energy performance of buildings directive( 15929/1/08).

Under the Energy Labelling Directive these acts take the form of delegated acts10 which are discussed by the Member States in an expert group, whilst for ecodesign these are implementing measures adopted under the'comitology' procedure with majority voting by the Member States in a Regulatory Committee.
This option would integrate a set of instruments to extend the scope of mandatory actions(Eco-design Directive for Energy Using products,Energy Efficiency Labelling Directive, including mandatory level of product performance for public procurement) and link them with voluntary actions(Eco-label, Green Public Procurement, Environmental Management and Audit Scheme).
Product labelling under the Energy Labelling Directive and Ecolabel Regulation will be further developed and, following a review of the Ecodesign Directive in 2012, complemented as appropriate by an Ecodesign Labelling Directive to provide consumers with information about the energy and/or environmental performance of products.
The final option chosen was to improve the existing regulatory framework on energy labelling, to require labelled products to be registered in a new database,improve the legal structure by changing the current Energy Labelling Directive to a Regulation, to align it with the market surveillance regulation12, and to fund EU joint market surveillance actions.
Measures implementing the Ecodesign and Energy Labelling directives and the Ecolabel Regulation for light sources are currently under revision or development: The Commission intends to adopt a new Ecodesign regulation that will cover directional light sources(reflector lamps).
Rigorous implementation of existing directives and regulations such as the recent Directive on Energy End-Use Efficiency andEnergy Services, the Labelling Directive and its eight implementing Directives, the Energy Performance of Buildings Directive, the Eco-Design Directive and the Energy Star Regulation will help to achieve the expected goals.
We await the revision of the Energy Efficiency Labelling Directive from the Commission this year, as the current A to G scheme for household appliances allows no further room for increased energy efficiency and, while very clear and consumer friendly, it is now creating marketing problems for genuinely more efficient products as it has reached its limit.
Concerning public procurement, the implementing measures under the Labelling Directive will identify one of the labelling classes as a level below which public authorities would not be allowed to procure.
Some time has passed since then,and the Commission decided to bring forward a proposal for recasting the Energy Labelling Directive, intending to bring further benefits to European citizens, industry and public authorities alike, firstly by extending its scope to all energy-related products, secondly by strengthening market surveillance, and thirdly by encouraging energy-efficient public procurement and incentive practices.
