Paragraph 8b of the same Regulation gives the right for Parties to the MARPOL73/78 Convention to deny entry into the ports or offshore terminals under their jurisdiction of oil tankers allowed to operate under this exception.
(a) in accordance with the conservation and management measures adopted bythe Meeting of the Parties, inter alia, inspect documents, fishing gear and catch on board fishing vessels, when such vessels are voluntarily in its ports or at its offshore terminals;
Under Regulation(EC) No 417/2002, a ship flying the flag of a Member State could apply the exemptions fromRegulation 13H if it operated outside ports or offshore terminals under Community jurisdiction and still comply with Regulation(EC) No 417/2002.
A Party may also inspect a ship when it enters the ports,shipyards, or offshore terminals under its jurisdiction, if a request for an investigation is received from any Party, together with sufficient evidence that a ship is operating or has operated in violation of this Convention.
It prohibits the carriage of heavy grades of oil in all single-hull tankers flying the flag of a MemberState irrespective of the jurisdiction governing the ports, offshore terminals or the maritime area in which they operate.
The entry into the ports or offshore terminals under the jurisdiction of a Member State of other Category(2) and Category(3) oil tankers, irrespective of the fact that they continue to operate under the flag of a third State in accordance with paragraph 5 of revised Regulation 13G of Annex I to MARPOL 73/78, shall no longer be allowed.
However, a ship flying the flag of a Member State could take advantage of the exemptions fromRegulation 13H if it operated outside ports or offshore terminals under Community jurisdiction and still comply with the amended Regulation(EC) No 417/2002.
(5) A Party may also inspect a ship to which thisAnnex applies when it enters the ports or offshore terminals under its jurisdiction, if a request for an investigation is received from any Party together with sufficient evidence that the ship has emitted any of the substances covered by the Annex in any place in violation of this Annex.
By way of derogation from Articles 4, 5 and 7, the competent authority of a Member State may, subject to national provisions, allow, under exceptional circumstances,an individual ship to enter the ports or offshore terminals under the jurisdiction of that Member State, when.
Irrespective of its flag, a single-hull oil tanker above 15 years of age shall not be allowed to enter orleave ports or offshore terminals or anchor in areas under the jurisdiction of a Member State unless it complies with the Condition Assessment Scheme referred to in Article 6.
The Regulation is amended by prohibiting the carriage of heavy grades of oil in all single-hull tankers flying the flag of a MemberState irrespective of the jurisdiction governing the ports, offshore terminals or the maritime area in which they operate.
In the event that a port State Contracting Party considers that a vessel of anotherContracting Party making use of its ports or offshore terminals has violated a provision of this Agreement or a conservation and management measure adopted by the Meeting of the Parties, it shall draw this to the attention of the flag State concerned and of the Meeting of the Parties.
Each Member State shall inform the IMO of its decision to deny entry of oil tankers, pursuant to Article 7 of this Regulation, operating in accordance with the provisions of paragraph 5 of revised Regulation13G of Annex I of MARPOL 73/78 into the ports or offshore terminals under its jurisdiction, on the basis of paragraph 8(b) of revised Regulation 13G of Annex I of MARPOL 73/78.
(10) It is in the Community's interest to adopt measures toensure that oil tankers entering into ports and offshore terminals under the jurisdiction of Member States and that oil tankers flying the flags of Member States comply with Regulation 13G of Annex I of MARPOL 73/78 as revised in 2001 by Resolution MEPC 95(46) in order to reduce the risk of accidental oil pollution in European waters.
Single hulled oil tankers are not allowed to operate under the flag of an EU country,nor are they allowed to enter into ports or offshore terminals under the jurisdiction of an EU country after the anniversary of the date of delivery of the ship in the year specified below.
No oil tanker carrying heavy grades of oil, irrespective of its flag,shall be allowed to enter or leave ports or offshore terminals or to anchor in areas under the jurisdiction of a Member State, unless such tanker is a double-hull oil tanker.
(6) The competent authority of the Government of a Party to the Convention may inspect the Oil Record Book on board any ship to which thisAnnex applies while the ship is in its port or offshore terminals and may make a copy of any entry in that book and may require the Master of the ship to certify that the copy is a true copy of such entry.
(c) provide assistance to flag State Contracting Parties, as reasonably practical and in accordance with its national law and international law,when a fishing vessel is voluntarily in its ports or at its offshore terminals and the flag State of the vessel requests it to provide assistance in ensuring compliance with the provisions of this Agreement and with the conservation and management measures adopted by the Meeting of the Parties.

The regulation applies to all tankers of 5 000 tonnes deadweight or above,which enter or leave a port or offshore terminal or anchor in an area under the jurisdiction of an EU country, irrespective of their flag, or which fly the flag of an EU country.
Each Member State shall take the necessary measures to ensure that every owner of a ship flying the flag of a third country has a financial guarantee in accordance with the provisions of the first paragraph,as soon as that ship enters a port or an offshore terminal under its jurisdiction or drops anchor in an area under its jurisdiction.
