Recalling that 2008 had marked the tenth anniversary of the successful negotiation of the Aarhus Convention andthat the Convention was open to all countries, one representative expressed regret that it had not been possible to adopt the draft guidelines on access to information and stated that his group would continue to work on them in their preparations for the next session of the UNEP Governing Council.

The Conference called upon ESCAP to prepare guidelines on access to information, public participation in decision-making and access to justice in environmental matters for governments and other public institutions in the region.
UNEP undertook a study of various models of national legislation,policies and guidelines on access to information, public participation in decision-making and access to justice in three regions, namely Africa, Asia and the Pacific and Latin America and the Caribbean.
Its Guidelines on Access to Information, Public Participation and Access to Justice with respect to GMOs are expected to be adopted by the Parties by a decision by which they will also set up a new working group on GMOs to further develop the application of the Convention in this area.
The Meeting will be invited to consider andadopt the draft guidelines on access to information, public participation and access to justice with respect to genetically modified organisms and to decide on future work on GMOs by adopting a draft decision on the topic.
The Guidelines on Access to Information, Public Participation and Access to Justice with respect to Genetically Modified Organisms(MP. PP/2002/7) were adopted by the Parties to the Convention at their first meeting(Lucca, Italy, 21-23 October 2002) as a non-legally binding and voluntary instrument with the aim of facilitating and giving guidance to the practical application of the provisions of the Convention and the development of national legal frameworks relevant to GMOs.
The Working Group noted the intention of the Meeting of the Parties to keep the Guidelines on Access to Information, Public Participation and Access to Justice with respect to Genetically Modified Organisms under review(ref. decision I/4, para. 2) and briefly considered how it might contribute to that process.
Supporting the continued use of the Guidelines on Access to Information, Public Participation and Access to Justice with respect to Genetically Modified Organisms(MP. PP/2003/3), which it adopted as a non-binding, voluntary instrument.
