Meaning of work of equal value.
Target 8.5 By 2030, achieve full and productive employment and decent work for all women and men, including for young people and persons with disabilities,and equal pay for work of equal value.
The Court has specified that Article 141(1)lays down the principle that equal work or work of equal value must be remunerated in the same way, whether it is performed by a man or a woman.
Enshrined in the Treaty of Rome in 1957, it was the subject of a 1975 directive which prohibits all discrimination in all aspects of pay between women andmen for the same work or for work of equal value.
(6a) The principle of equal pay for male andfemale workers for equal work or work of equal value is laid down in Article 157 of the Treaty on the Functioning of the European Union TFEU.
This Article, which has become Article 141 of the Treaty, now stipulates that each Member State must ensure that the principle of equal pay for male andfemale workers for equal work or work of equal value is applied(see Annex).
Recalls that the principle of equal pay for maleand female workers for equal work or work of equal value is enshrined and defined in Article 157 of the TFEU and needs to be applied effectively by the Member States;
I support the report on precarious women workers because I cannot conceive that in the 21st century, major differences persist in relation to women in the European Union with regard to employment opportunities, quality of work, income and equal pay for equal work or work of equal value.
(8) The principle of equal pay for equal work or work of equal value as laid down by Article 141 of the Treaty constitutes an important aspect of the principle of equal treatment between men and women.
It is important that Member States take the necessary measures toensure that infringement of the principle of equal pay for work of equal value is subject to appropriate sanctions according to the legal provisions in force.
(i) Fair wages and equal remuneration for work of equal value without distinction of any kind, in particular women being guaranteed conditions of work not inferior to those by men, with equal pay for equal work; .
A gender pay gap of 16.2%(2010, in average hourly earnings),which is partly due to women earning lower pay for work of equal value, and partly due to women being concentrated in jobs that pay less.
European laws or framework laws shall establish measures to ensure the application of the principle of equal opportunities and equal treatment of women and men in matters of employment and occupation,including the principle of equal pay for equal work or work of equal value.
When the differences identified in the pay conditions of workers of different sex performing equal work or work of equal value cannot be attributed to a single source, they do not come within the scope of Article 141(1) EC17.
The Council, acting in accordance with the procedure referred to in Article 251, and after consulting the Economic and Social Committee, shall adopt measures to ensure the application of the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation,including the principle of equal pay for equal work or work of equal value.
However, where, the differences identified in the payconditions of workers performing equal work or work of equal value cannot be attributed to a single source, there is no body which is responsible for the inequality and which could restore equal treatment.
The European Parliament and the Council, acting in accordance with the ordinary legislative procedure, and after consulting the Economic and Social Committee, shall adopt measures to ensure the application of the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation,including the principle of equal pay for equal work or work of equal value.
Therefore, the principle of equal pay for men and women,implies that remuneration for the same work or work of equal value need not necessarily be paid by one and the same employer, but must originate from a single source to which any differences identified in pay conditions can be attributed.
Amendment(27 a) The Member States should ensure the elimination of all kind of discrimination with regard to all aspects of remuneration,respecting the principle of equal pay for equal work and work of equal value, and in the terms and conditions of employment, regardless of the contract type of the worker as defined by this Directive.
The Member States shall ensure theprinciple of equal pay for equal work and work of equal value and put in place measures that ensure that employers in undertakings and organisations regularly inform of the average remuneration by category of employee or position, broken down by gender.
