This Framework Decision shall apply to Gibraltar.
Member States shall take the necessary measures to comply with the provisions of this Framework Decision before 2 August 2005.
This framework Decision shall enter into force on the day of its publication in the Official Journal.
Requests received after that date will be governed by the rules adopted by Member States pursuant to this Framework Decision.
Consent shall be given when the offence for which it is requested is itself subject to surrender in accordance with the provisions of this Framework Decision.

The scope of application of this Framework Decision is limited to the processing of personal data transmitted or made available between Member States.
By the same date Member States shall transmit to the General Secretariat of the Council andto the Commission the text of the provisions transposing into their national law the obligations imposed on them under this Framework Decision.
This Framework Decision is limited to refining the definition of grounds for non-recognition in instruments implementing the principle of mutual recognition.
On the basis of that information the Commission shall, by 27 April 2015, present a report to the European Parliament andthe Council on the application of this Framework Decision, accompanied if necessary by legislative proposals.
This Framework Decision shall not have the effect of modifying the obligation to respect fundamental rights and fundamental legal principles as enshrined in Article 6 of the Treaty on European Union.'.
By[5 years after entry into force of this Directive and every 5 years thereafter],the Commission shall assess the extent to which the Member States have taken the necessary measures to comply with this Framework Decision and publish a report.

In respect of new psychoactive substances subjected to permanent market restriction on the basis of[Article 13(1) of Regulation(EU) No…/… on new psychoactive substances], Member States shall bring into force the laws, regulations andadministrative provisions necessary to apply the provisions of this Framework Decision to these new psychoactive substances within twelve months after entry into force of the permanent market restriction.
This Framework Decision is aimed at refining the definition of such common grounds allowing the executing authority to execute the decision despite the absence of the person at the trial, while fully respecting the person's right of defence.
In respect of new psychoactive substances subjected to permanent market restriction on the basis of[Article 13(1) of Regulation(EU) No…/… on new psychoactive substances] added to the Annex to this Framework Decision, Member States shall bring into force the laws, regulations and administrative provisions necessary to apply the provisions of this Framework Decision to these new psychoactive substances within twelve months after the entry into force of the permanent market restriction amendment to the Annex.
The objectives of this Framework Decision are to enhance the procedural rights of persons subject to criminal proceedings, to facilitate judicial cooperation in criminal matters and, in particular, to improve mutual recognition of judicial decisions between Member States.
However, any Member State may,at the time of the adoption of this Framework Decision by the Council, make a statement indicating that as executing Member State it will continue to deal with requests relating to acts committed before a date which it specifies in accordance with the extradition system applicable before 1 January 2004.
The provisions of this Framework Decision amending other Framework Decisions set conditions under which the recognition and execution of a decision rendered following a trial at which the person concerned did not appear in person should not be refused.
The reason for this is that this Framework Decision only comes into play if the person has already been released in the issuing State and wants to return as a free person to his home country and is ready to cooperate with the supervising authorities.
Any Member State may,either when this Framework Decision is adopted or at a later date, state in a declaration deposited with the General Secretariat of the Council that it will accept a translation in one or more other official languages of the institutions of the European Communities.
